【摘要】：有效的產權保護制度是充分發(fā)揮產權的激勵、約束和資源配置功能的重要前提,是完善的社會主義市場經濟體制的重要制度基礎。構建有效的產權保護制度,核心是要完善產權保護行政管理體制,加快政府職能轉變,嚴格依法行政,加強產權保護,防止公權侵害私權;同時,要健全產權保護的法制保障體制,完善平等保護產權的法律體系,確保司法權威和司法機關廉潔高效。結合當前我國產權保護實際需要,關鍵是要加強頂層設計和統籌協調,堅持公平、效率、平等、平衡原則,加快私有產權、國有產權、集體產權和知識產權等重點領域產權保護的體制機制建設。
[Abstract]:Property rights protection system and make full use of property rights incentive, an important precondition constraint and resource allocation function, is an important basis for perfecting the socialist market economic system. The construction of property right, the core is to improve the protection of property rights of administrative management system, accelerate the transformation of government functions, strictly according to law, strengthen the protection of property rights, prevent the public against private rights; at the same time, to improve the protection of property rights of the legal system, perfecting the legal system of equal protection of property rights, to ensure a clean and efficient judicial authority and judicial organs. Combined with the actual need of China's current property protection, the key is to strengthen top-level design and co-ordination, adhere to fairness, efficiency, equality, the principle of balance, speed up the private property right the state-owned property right, mechanism construction, key areas of property protection of collective property rights and intellectual property rights.
