【摘要】：當前我國房地產(chǎn)市場交易性矛盾頻發(fā)。依據(jù)發(fā)生機制不同,其主要表現(xiàn)為市場風(fēng)險型、欺詐剝奪型、止損避險型與失衡補償型四種類型。這些矛盾已凸顯出結(jié)構(gòu)層次復(fù)雜、受宏觀調(diào)控政策影響大、偏好采取集體維權(quán)行動,以及易于被制度化疏解而難以終結(jié)等總體特征;從發(fā)生邏輯看,市場交易性矛盾主要源于國家市場調(diào)控權(quán)力的內(nèi)卷化與地方選擇的城市增長聯(lián)盟發(fā)展模式。基于此,可以從改革發(fā)展模式重塑市場機制,加強法治建設(shè)規(guī)制市場主體行為,以及動員多元社會力量共建城市權(quán)利保障機制三個方面進行相應(yīng)治理。
[Abstract]:At present, China's real estate market has frequent trading contradictions. According to the different mechanism of occurrence, it mainly shows four types of market risk type, fraud deprivation type, stop loss type and unbalance compensation type. These contradictions have highlighted the complex structure, affected by the macro-control policy, prefer to take collective rights of action, and easy to be institutionalized to ease the end of general characteristics; from a logical perspective, the main source of city market contradiction involution in state power and local market regulation and the choice of the growth mode of development alliance. Based on this, we can restructure the market mechanism from the perspective of reform and development mode, strengthen the rule of law, regulate the behavior of market participants, and mobilize multiple social forces to jointly establish the three aspects of urban rights protection mechanism.
