【摘要】：職業(yè)教育是我國教育體系的重要組成部分,對社會經濟發(fā)展具有重要意義。作為我國農村經濟社會發(fā)展的重要基礎和農村教育工作的戰(zhàn)略重點,農村職業(yè)教育在為農民職業(yè)技術和職業(yè)培訓以及農村勞動力轉移方面發(fā)揮著巨大作用。大力發(fā)展農村職業(yè)教育,對有效轉移農村剩余勞動力,解決“三農”問題,有效推進城鄉(xiāng)統(tǒng)籌發(fā)展起著標本兼治的作用。進入新世紀以來,伴隨著《國家中長期教育改革和發(fā)展規(guī)劃綱要(2010—2020)》的出臺,農村職業(yè)教育的快速健康發(fā)展被提上國家的重要議事日程。但與其快速發(fā)展之不相適應的是：目前我國整個職業(yè)教育法律法規(guī)建設(包括農村職業(yè)教育)非常滯后,相關的法律規(guī)范非常缺乏,本應以法律進行規(guī)范的內容在現(xiàn)實中往往表現(xiàn)為一系列的政策制定,其權威性與有效性被大大降低,根本無法滿足農村職業(yè)教育發(fā)展的需要,同時也與世界職業(yè)教育法制化發(fā)展的潮流相違背。 鑒于此,本文將以如何實現(xiàn)教育公平,促進農村職業(yè)教育法制化為研究視角,分析我國農村職業(yè)教育法制建設現(xiàn)狀及其法制建設過程中存在的主要問題;在對我國農村職業(yè)教育立法現(xiàn)狀進行相關分析的基礎上,思考如何從法律層面構建農村職業(yè)教育的良好運行環(huán)境,最后結合相關分析的結果,同時借鑒美、日、德等發(fā)達國家職業(yè)教育立法的成功經驗,為建立適應我國農村職業(yè)教育發(fā)展的職業(yè)教育法律法規(guī)保障體系提出了幾點試探性的建議。
[Abstract]:Vocational education is an important part of China's education system, which is of great significance to social and economic development. As an important foundation of rural economic and social development and the strategic focus of rural education, rural vocational education plays an important role in providing vocational and technical training for farmers as well as the transfer of rural labor force. The development of rural vocational education plays an important role in effectively transferring rural surplus labor force, solving the problem of "agriculture, countryside and farmers" and effectively promoting the overall development of urban and rural areas. Since the beginning of the new century, with the introduction of the National medium and long term Education Reform and Development Program (2010-2020), the rapid and healthy development of rural vocational education has been put on the important agenda of the country. However, with the rapid development of vocational education, the construction of laws and regulations of vocational education (including rural vocational education) is lagging behind, and the relevant laws and regulations are very lacking. The content which should be standardized by law is often manifested as a series of policy formulation in reality, whose authority and effectiveness are greatly reduced, and can not meet the needs of the development of rural vocational education. At the same time, it also runs counter to the trend of legalization development of vocational education in the world. In view of this, this article will take how to realize the education fair, promotes the countryside vocational education legalization as the research angle, analyzes our country countryside vocational education legal system construction present situation and the legal system construction process main question; Based on the analysis of the current situation of rural vocational education legislation in China, the author thinks about how to construct a good operating environment of rural vocational education from the legal level, and finally combines the results of relevant analysis, and at the same time draws lessons from the United States and Japan. The successful experience of vocational education legislation in Germany and other developed countries puts forward some tentative suggestions for the establishment of a guarantee system of vocational education laws and regulations adapted to the development of rural vocational education in China.
