【摘要】：《狄?jiàn)W多西法典》是古羅馬第一部官方法律匯編,共有16卷,體育法規(guī)范出現(xiàn)在其第15卷第5題、第9題、第10題、第11題、第12題、第13題,涉及表演活動(dòng)、賽會(huì)花費(fèi)、戰(zhàn)車競(jìng)賽用的馬匹、斗獸活動(dòng)、角斗士和座位使用方面的行政管理規(guī)定,呈現(xiàn)出體育管理法與娛樂(lè)管理法不分、基督教色彩濃厚、反腐禁奢規(guī)定鮮明、提倡社會(huì)力量辦賽與國(guó)家壟斷特定項(xiàng)目并存等特點(diǎn),既有進(jìn)步的文明基因,也有糟粕殘留。整理、翻譯與評(píng)注《狄?jiàn)W多西法典》中的體育法規(guī)范,有助于加深我國(guó)學(xué)界外國(guó)體育史研究的深度與廣度,并為研究羅馬帝國(guó)后期體育史留下第一手原始文獻(xiàn)。
[Abstract]:The Code of Theodoxy is the first official collection of laws in ancient Rome, in which the norms of sports law appear in title 5, title 9, question 10, question 11, question 12, question 13, relating to performing activities, and the rules of sports law appear in its title 15, title 5, title 9, question 10, question 11, question 12, question 13, relating to performing activities, which will be spent. The administrative regulations on horses, fighting animals, gladiators and seat use used in chariot competitions show that the sports management law is not separated from the entertainment management law, the Christian color is strong, and the anti-corruption and extravagance prohibition regulations are clear. It advocates the coexistence of social power competition and state monopoly, which has both progressive civilization genes and dross residues. Sorting out, translating and commenting on the norms of sports law in the Code of Theodore helps to deepen the depth and breadth of the study of the history of foreign sports in Chinese academic circles, and to leave first-hand original documents for the study of the history of sports in the late Roman Empire.
