高校體育商業(yè)化過程中的學(xué)生運(yùn)動(dòng)員報(bào)酬問題——基于《謝爾曼法》的考察

【摘要】:學(xué)生運(yùn)動(dòng)員的報(bào)酬問題是我國(guó)高校體育商業(yè)化過程中不可回避的一個(gè)問題,對(duì)這個(gè)問題的回答可借鑒美國(guó)經(jīng)驗(yàn)。近年來,美國(guó)學(xué)校體育中的學(xué)生運(yùn)動(dòng)員報(bào)酬給付規(guī)則遇到了很大的法律挑戰(zhàn),美國(guó)法院的判決結(jié)果不僅會(huì)影響學(xué)生運(yùn)動(dòng)員的經(jīng)濟(jì)權(quán)益、法律地位,還可能會(huì)給美國(guó)高校體育管理結(jié)構(gòu)造成顛覆性的影響。采用文獻(xiàn)資料調(diào)研、對(duì)比分析、邏輯分析、例證等方法,對(duì)美國(guó)學(xué)校體育中的學(xué)生運(yùn)動(dòng)員報(bào)酬給付規(guī)則是否違反《謝爾曼法》進(jìn)行探討,并在此基礎(chǔ)上對(duì)是否應(yīng)向?qū)W生運(yùn)動(dòng)員支付薪酬等問題進(jìn)行論證,提出我國(guó)在發(fā)展高校體育過程中應(yīng)當(dāng)重視商業(yè)化和業(yè)余化的平衡,合理利用法律來保護(hù)學(xué)生運(yùn)動(dòng)員的權(quán)益。
[Abstract]:The compensation of student athletes is an unavoidable problem in the process of sports commercialization in colleges and universities in China. The answer to this question can draw lessons from the experience of the United States.In recent years, the rules of compensation and payment for student athletes in American school sports have met with great legal challenges. The decision of American courts will not only affect the economic rights and interests of student athletes, but also their legal status.It may also have a subversive effect on the management structure of physical education in American colleges and universities.By means of literature investigation, comparative analysis, logic analysis and illustration, this paper probes into whether the rules of compensation and payment for student athletes in American school physical education violate the Sherman Act.On the basis of this, the author demonstrates whether the salary should be paid to student athletes, and puts forward that China should pay attention to the balance of commercialization and amateurization in the process of developing sports in colleges and universities, and make rational use of the law to protect the rights and interests of student athletes.
