足協(xié)U23新政的勞動(dòng)法分析——以平等就業(yè)權(quán)為分析工具

【摘要】:足協(xié)為了推動(dòng)國(guó)家隊(duì)打進(jìn)2022年世界杯而培養(yǎng)年輕球員,出臺(tái)U23新政,但該新政對(duì)部分U23以上球員的權(quán)益產(chǎn)生了明顯不利影響。U23以上球員作為勞動(dòng)法上的勞動(dòng)者,依法享有平等就業(yè)權(quán)。平等就業(yè)權(quán)的結(jié)構(gòu)模型包括3個(gè)具體規(guī)則:勞動(dòng)關(guān)系存續(xù)期間的平等就業(yè)規(guī)則、建立勞動(dòng)關(guān)系時(shí)的平等就業(yè)規(guī)則以及平等就業(yè)權(quán)的適用除外規(guī)則。U23以上球員在勞動(dòng)關(guān)系存續(xù)期間的平等就業(yè)權(quán)主要表現(xiàn)為上場(chǎng)機(jī)會(huì)與時(shí)間,U23新政剝奪了2名U23以上球員的上場(chǎng)機(jī)會(huì),侵犯其平等就業(yè)權(quán);受到勞動(dòng)關(guān)系存續(xù)期間不能上場(chǎng)以及俱樂(lè)部U23球員儲(chǔ)備不足的影響,部分U23以上球員在轉(zhuǎn)會(huì)時(shí)喪失了應(yīng)有的談判話(huà)語(yǔ)權(quán),U23新政侵犯其建立勞動(dòng)關(guān)系時(shí)的平等就業(yè)權(quán);U23新政既未考量U23以上球員真實(shí)職業(yè)資格與能力,也不符合國(guó)家利益需要及比例原則,故該新政不能適用平等就業(yè)權(quán)之除外規(guī)則。因此,足協(xié)U23新政侵犯了部分U23以上球員的平等就業(yè)權(quán),無(wú)法通過(guò)勞動(dòng)法的審視。
[Abstract]:The Football Association has introduced the U23 New deal to promote the national team to the World Cup in 2022 to train young players. But the new deal has had a significant negative impact on the rights and interests of some U23 and more players as labor law workers. The structural model of equal employment rights includes three specific rules: the equal employment rules during the existence of labor relations. The rules of equal employment when establishing labor relations and the application of the exception of equal employment rights. The equal employment rights of players above U23 during the existence of labor relations are mainly reflected in the playing opportunity and time. The U23 New deal deprives two or more U23 players of the right to play and violates their right to equal employment; Due to the absence of labor relations and the insufficient reserves of U23 players, some of the U23 players have lost their right to negotiate in the transfer. U23 the New deal infringes on its equal right to employment when it establishes labour relations; The U23 New deal does not take into account the true professional qualifications and abilities of the U23 or above players, nor does it meet the needs of the national interest and the principle of proportionality. Therefore, the New deal cannot apply the exclusion rule of equal employment rights. The FA's U23 New deal infringes on the equal employment rights of some U23 + players and cannot be examined by labor laws.
