【摘要】：2001年12月11日,中國(guó)加入世界貿(mào)易組織,高等教育服務(wù)貿(mào)易已經(jīng)被納入世界貿(mào)易組織,我國(guó)對(duì)高等教育服務(wù)貿(mào)易作出了法律承諾,逐漸開放我國(guó)的高等教育市場(chǎng)。這一措施給我國(guó)高等教育服務(wù)貿(mào)易帶來了契機(jī),同時(shí)也給我國(guó)高等教育服務(wù)貿(mào)易的發(fā)展帶來了挑戰(zhàn)。我國(guó)高等教育服務(wù)貿(mào)易的法律承諾存在問題,恰如其分地處理好這些問題可以促進(jìn)我國(guó)高等教育服務(wù)貿(mào)易的良性發(fā)展。本文以高等教育服務(wù)貿(mào)易的法律承諾為中心,具體分為以下五個(gè)部分進(jìn)行論述： 第一部分,緒論。主要包括本文研究背景,對(duì)國(guó)內(nèi)外研究現(xiàn)狀進(jìn)行說明和評(píng)述,研究的內(nèi)容、目標(biāo)、方法和框架,本文的創(chuàng)新之處。 第二部分,高等教育服務(wù)貿(mào)易概述。本部分主要從高等教育服務(wù)貿(mào)易的內(nèi)涵和發(fā)展現(xiàn)狀進(jìn)行論述。在分析了相關(guān)國(guó)際性文件后,借鑒《服務(wù)貿(mào)易總協(xié)定》的相關(guān)規(guī)定對(duì)高等教育服務(wù)貿(mào)易進(jìn)行了界定。高等教育服務(wù)可以進(jìn)入貿(mào)易領(lǐng)域成為貿(mào)易的一種產(chǎn)品,高等教育服務(wù)貿(mào)易發(fā)展迅速。 第三部分,高等教育服務(wù)貿(mào)易法律承諾分析。本部分從法律承諾內(nèi)容、法律承諾現(xiàn)狀和法律承諾的發(fā)展趨勢(shì)三個(gè)方面進(jìn)行論述。法律承諾分為水平承諾和部門承諾,WTO成員國(guó)作出了不同的法律承諾。隨著高等教育服務(wù)貿(mào)易的發(fā)展,法律承諾會(huì)出現(xiàn)一些新的發(fā)展趨勢(shì)：第一,更多發(fā)展中國(guó)家會(huì)參與法律承諾的談判；第二,雖然發(fā)展中國(guó)家會(huì)越來越多的參與,但是發(fā)達(dá)國(guó)家仍將在很長(zhǎng)時(shí)間內(nèi)處于法律承諾的優(yōu)勢(shì)地位；笫三,發(fā)展中國(guó)家和發(fā)達(dá)國(guó)家的利益不同,最后達(dá)成的法律承諾內(nèi)容會(huì)呈現(xiàn)復(fù)雜性。 第四部分,我國(guó)高等教育服務(wù)貿(mào)易的法律承諾分析。本部分主要從承諾內(nèi)容、原因以及與其他國(guó)家的對(duì)比分析三個(gè)方面進(jìn)行論述。根據(jù)我國(guó)國(guó)情,我國(guó)對(duì)高等教育服務(wù)貿(mào)易進(jìn)行部分承諾,有選擇地開放高等教育服務(wù)貿(mào)易市場(chǎng)。美國(guó)、澳大利亞作為發(fā)達(dá)國(guó)家的代表、印度作為發(fā)展中國(guó)家的代表,將這三個(gè)國(guó)家高等教育服務(wù)貿(mào)易的法律承諾內(nèi)容與我國(guó)進(jìn)行比較分析。相比這三個(gè)國(guó)家,我國(guó)承諾水平不高。 第五部分.我國(guó)高等教育服務(wù)法律承諾的問題及對(duì)策。在問題方面：法律承諾內(nèi)容存在缺陷；我國(guó)國(guó)內(nèi)相關(guān)立法體系混亂,立法內(nèi)容不完善；我國(guó)在實(shí)施法律承諾時(shí)仍然存在不足之處。在對(duì)策方面：完善法律承諾內(nèi)容；借鑒法國(guó)、日本、美國(guó)、澳大利亞的立法經(jīng)驗(yàn)重構(gòu)我國(guó)立法體系,完善立法內(nèi)容；對(duì)實(shí)施法律承諾過程中的不足進(jìn)行改進(jìn),使得我國(guó)能夠有效地實(shí)施法律承諾的相關(guān)內(nèi)容。
[Abstract]:On December 11, 2001, China joined the World Trade Organization (WTO), and higher education service trade has been brought into WTO. China has made a legal commitment to higher education service trade and gradually opened up our higher education market. This measure not only brings the opportunity to the service trade of higher education in China, but also challenges the development of the service trade of higher education in our country. There are some problems in the legal commitment of China's higher education service trade, which can be properly dealt with to promote the healthy development of China's higher education service trade. This paper focuses on the legal commitment of higher education trade in services, specifically divided into the following five parts: the first part, introduction. This article mainly includes the research background, the domestic and foreign research present situation to carry on the explanation and the commentary, the research content, the goal, the method and the frame, the article innovation place. The second part is an overview of service trade in higher education. This part mainly from the higher education service trade connotation and the development present situation carries on the elaboration. After analyzing the relevant international documents, this paper defines the service trade of higher education by referring to the relevant provisions of the General Agreement on Trade in Services (GATS). Higher education service can enter the trade field as a product of trade, and higher education service trade develops rapidly. The third part, the higher education service trade legal commitment analysis. This part discusses the content of legal commitment, the status quo of legal commitment and the development trend of legal commitment. Legal commitment is divided into horizontal commitment and sectoral commitment. With the development of trade in higher education services, there will be some new trends in legal commitments: first, more developing countries will participate in the negotiation of legal commitments; second, while developing countries will participate more and more, However, developed countries will still be in the dominant position of legal commitment for a long time. Third, the interests of developing countries and developed countries are different, and the final content of legal commitments will be complicated. The fourth part, the analysis of the legal commitment of China's higher education service trade. This part mainly from the commitment content, the reason and the contrast analysis with other countries three aspects carries on the discussion. According to the situation of our country, our country has made some promises to the service trade of higher education, and has selectively opened the market of service trade of higher education. The United States, Australia as the representative of the developed countries and India as the representative of the developing countries, compare the contents of the legal commitments of the three countries' higher education service trade with China. Compared with these three countries, our commitment level is not high. Part V The problems and Countermeasures of the legal commitment of higher Education Service in China. In terms of problems: there are defects in the content of legal commitment; the relevant legislative system in China is chaotic; the content of legislation is not perfect; there are still deficiencies in the implementation of legal commitments in our country. In the aspect of countermeasures: perfect the content of legal commitment, learn from the legislative experience of France, Japan, the United States and Australia to reconstruct our legislative system, perfect the content of legislation, improve the deficiency in the process of implementing legal commitment, So that China can effectively implement the relevant content of legal commitments.
