診所式法律教育的本土化模式研究

【摘要】:在改革開(kāi)放和我國(guó)加入WTO的大背景下,應(yīng)用型的法律人才越來(lái)越受到社會(huì)的廣泛歡迎。但是目前,我國(guó)高校的法學(xué)教育仍然采用以理論灌輸為主的教學(xué)方式,以此方式培養(yǎng)的法律人才缺乏實(shí)踐能力,不符合現(xiàn)代社會(huì)對(duì)法律人才的要求。于是2000年9月,一種起源于美國(guó)的新型培養(yǎng)實(shí)踐型法律人才的教學(xué)方法即診所式法律教育進(jìn)入我國(guó)高校法學(xué)院。它是借鑒醫(yī)學(xué)院利用診所培養(yǎng)實(shí)習(xí)醫(yī)生的形式,,倡導(dǎo)在實(shí)踐中和經(jīng)驗(yàn)中學(xué)習(xí)法律。這種教學(xué)方法的引入,推動(dòng)了我國(guó)法學(xué)教育改革,培養(yǎng)了學(xué)生的實(shí)踐能力。但是由于這種教學(xué)方法是西方的舶來(lái)品,因此,在我國(guó)高校的實(shí)踐中存在許多的問(wèn)題。如何使這種教學(xué)方法能夠適應(yīng)我國(guó)的國(guó)情是論文研究的核心問(wèn)題。 論文采用了文獻(xiàn)研究法、比較研究法和案例研究法三種方法展開(kāi)研究。論文針對(duì)診所式法律教育在我國(guó)高校實(shí)踐中存在的問(wèn)題如案源不足、師資匱乏、資金匱乏等問(wèn)題提出了相應(yīng)的解決策略,比如可以通過(guò)與律師事務(wù)所、婦聯(lián)、殘聯(lián)等部門聯(lián)系解決案源有限問(wèn)題;可以通過(guò)聘請(qǐng)法官、檢察官等專家到法律診所做兼職教師可以解決教師匱乏問(wèn)題;可以通過(guò)將法學(xué)實(shí)踐環(huán)節(jié)整合到法律診所中去,解決診所資金匱乏問(wèn)題等等。與思想政治教育內(nèi)容與方法相結(jié)合的法律診所,具有合理評(píng)價(jià)機(jī)制的法律診所,重視開(kāi)展法學(xué)實(shí)踐基地的法律診所是符合我國(guó)國(guó)情的法律診所。 在理論意義方面,論文針對(duì)診所式法律教育在我國(guó)高校的實(shí)踐中所存在的問(wèn)題提出了相應(yīng)的解決對(duì)策,為我國(guó)診所式法律教育的本土化模式研究提供一定的理論借鑒與參考。在實(shí)踐意義方面,通過(guò)對(duì)診所式法律教育本土化的研究,在實(shí)踐上提出了如何進(jìn)行法律診所本土化的具體操作思路,使得診所式法律教育更加適合我國(guó)的國(guó)情,更具可操作性。
[Abstract]:Under the background of reform and opening up and China's entry into WTO, applied legal talents are more and more popular in society. But at present, the law education in our country still adopts the teaching method which is mainly based on the theory indoctrination. The legal talents trained in this way lack the practical ability and do not meet the requirements of the modern society for the legal talents. So in September, 2000, a new teaching method of cultivating practical law talents, namely clinic law education, came into law school in our country. It is to learn from the practice of medical schools to cultivate interns and advocate learning law in practice and experience. The introduction of this teaching method promotes the reform of law education and cultivates the students' practical ability. However, because this teaching method is imported from the West, there are many problems in the practice of colleges and universities in our country. How to adapt this teaching method to the situation of our country is the core problem of this paper. This paper adopts three methods: literature research, comparative research and case study. The paper puts forward the corresponding solutions to the problems existing in the practice of clinical legal education in our country, such as the lack of case source, the shortage of teachers, the shortage of funds, and so on. For example, we can solve the problems by working with law firms, women's federations, etc. Departments such as the disabled Persons' Federation can contact and solve the problem of limited sources of cases; they can solve the problem of lack of teachers by hiring judges, prosecutors and other experts to work as part-time teachers in legal clinics; and they can integrate the practice of law into legal clinics. To solve the problem of lack of funds in clinics and so on. The law clinic combined with the contents and methods of ideological and political education, the law clinic with reasonable evaluation mechanism, and the law clinic which attaches importance to the development of the legal practice base is the law clinic in accordance with the national conditions of our country. In terms of theoretical significance, the paper puts forward corresponding solutions to the problems existing in the practice of clinical legal education in colleges and universities in our country, and provides some theoretical references and references for the study of the localization mode of clinical legal education in China. In the aspect of practical significance, through the study of the localization of clinic legal education, the author puts forward the concrete operational thinking of how to carry out the localization of legal clinic in practice, which makes the clinic legal education more suitable for the national conditions of our country and more operable.
