【摘要】：美國(guó)現(xiàn)代法學(xué)教育與法理學(xué)的形成和發(fā)展,在相當(dāng)程度上,是與其現(xiàn)代法學(xué)院的建構(gòu)和發(fā)展緊密相關(guān)的;在一定意義上,美國(guó)本土法理學(xué)是美國(guó)社會(huì)對(duì)法律之現(xiàn)實(shí)需求的實(shí)用性智識(shí)回應(yīng),而法學(xué)院則在這一智識(shí)回應(yīng)過(guò)程中發(fā)揮著不可或缺的功用。隨著現(xiàn)代法學(xué)教育的重心從哥倫比亞大學(xué)向哈佛、耶魯、芝加哥等大學(xué)法學(xué)院的順次移轉(zhuǎn),美國(guó)現(xiàn)代法理學(xué)也先后經(jīng)歷了蘭德?tīng)柺降姆煽茖W(xué)傳統(tǒng)、法律現(xiàn)實(shí)主義、法律研究的政策科學(xué)視角、過(guò)程法理學(xué)以及法律與經(jīng)濟(jì)學(xué)等交叉學(xué)科法理學(xué)研究的發(fā)展演進(jìn)過(guò)程,從而形成了一個(gè)獨(dú)具美國(guó)特色的現(xiàn)代法理學(xué)譜系。
[Abstract]:The formation and development of modern law education and jurisprudence in the United States, to a certain extent, are closely related to the construction and development of its modern law school. American native jurisprudence is the practical intellectual response of American society to the practical need of law, and law school plays an indispensable role in the process of this intellectual response. With the shift of modern law education from Columbia University to Harvard, Yale, Chicago and other law schools, modern jurisprudence in the United States has experienced Randall's tradition of legal science and legal realism. From the perspective of policy science, process jurisprudence and law and economics, a modern jurisprudence pedigree with American characteristics has been formed.
