“縣管校聘”背景下教師專業(yè)人員身份的困境與再確認(rèn)

【摘要】:《教師法》將教師身份定位于"專業(yè)人員",但該身份在實(shí)踐中尤其是"縣管校聘"試點(diǎn)地區(qū)教師管理體制改革過程中遭遇了諸多困境。受制于"專業(yè)人員"身份的內(nèi)涵與外延,教師的權(quán)利義務(wù)、管理方式和權(quán)益受損時(shí)的法律救濟(jì)等問題的解決均欠缺法理基礎(chǔ)。為推進(jìn)試點(diǎn)地區(qū)教師交流輪崗的順利進(jìn)行,應(yīng)將公立義務(wù)教育階段教師界定為"國家工作人員",同時(shí)推進(jìn)教師行政合同的有效適用和相關(guān)配套制度的完善,為教師管理體制改革保留一定的空間。
[Abstract]:The teacher Law defines the teacher status as a "professional", but in practice, especially in the process of the reform of the teacher management system in the pilot area of "county management and school recruitment", the teacher management system has encountered many difficulties. There is no legal basis for solving the problems such as the connotation and extension of "professional" identity, the rights and obligations of teachers, the ways of management and the legal remedies when their rights and interests are damaged. In order to promote the smooth progress of teacher exchange and rotation in the pilot area, teachers in the stage of public compulsory education should be defined as "national staff", meanwhile, the effective application of teachers' administrative contract and the improvement of related supporting system should be promoted. Reserved some space for the reform of teacher management system.
