【摘要】：完善民辦教育的頂層制度設(shè)計(jì)是破解當(dāng)前民辦教育發(fā)展難題不可回避的課題。民辦教育的頂層制度設(shè)計(jì)之爭(zhēng)始于20世紀(jì)90年代末期國家民辦教育立法至今。貫徹實(shí)施《國家中長(zhǎng)期教育改革和發(fā)展規(guī)劃綱要(2010-2020年)》以來開展的新一輪民辦教育頂層制度設(shè)計(jì)之爭(zhēng),集中在是否取消"合理回報(bào)"制度,如何推進(jìn)營(yíng)利性和非營(yíng)利性民辦學(xué)校分類管理,如何界定營(yíng)利性和非營(yíng)利性民辦學(xué)校的邊界,如何界定與保障民辦學(xué)校非捐贈(zèng)性出資人的權(quán)益。目前應(yīng)明確界定營(yíng)利性和非營(yíng)利性民辦學(xué)校分類標(biāo)準(zhǔn),完善分類的配套扶持政策和管理辦法,對(duì)于現(xiàn)有民辦學(xué)校,由其自愿選擇是否申請(qǐng)營(yíng)利性或非營(yíng)利性的學(xué)校性質(zhì),給其留出充足過渡期,這將有利于民辦教育事業(yè)的發(fā)展。
[Abstract]:Perfecting the top level system design of private education is an unavoidable task to solve the current problems in the development of private education. The top-level system design of private education began in the late 1990s, the national private education legislation. A new round of disputes over the design of the top level system of private education since the implementation of the outline of the National medium and long term Education Reform and Development Program (2010-2020) has focused on whether to abolish the "reasonable return" system, How to promote the classified management of profit-making and non-profit private schools, how to define the boundary between for-profit and non-profit private schools, and how to define and protect the rights and interests of non-donated investors in private schools. At present, it is necessary to clearly define the classification criteria for for-profit and non-profit private schools, improve the supporting policies and management methods for the classification, and voluntarily choose whether to apply for profit-making or not-for-profit schools for the existing private schools. Give it sufficient transition period, this will be conducive to the development of private education.
