S大學(xué)教師參與學(xué)校治理的現(xiàn)狀研究

【摘要】:大學(xué)教師參與大學(xué)治理,是指作為大學(xué)治理過(guò)程中的重要利益相關(guān)者,包括教授和非教授職稱(chēng)在內(nèi)的全體大學(xué)教師,在大學(xué)教學(xué)、科研、人事、后勤等不同領(lǐng)域的治理事務(wù)中,擁有合法合理的參與權(quán)利,能維護(hù)自身權(quán)益,促進(jìn)大學(xué)治理中決策的科學(xué)化、民主化,提高大學(xué)治理的現(xiàn)代化水平!秶(guó)家中長(zhǎng)期教育改革與發(fā)展規(guī)劃綱要》提出到2020年基本實(shí)現(xiàn)教育現(xiàn)代化,2015年國(guó)務(wù)院《統(tǒng)籌推進(jìn)世界一流大學(xué)和一流學(xué)科建設(shè)總體方案》表明要統(tǒng)籌推進(jìn)世界一流大學(xué)和一流學(xué)科建設(shè),建設(shè)高等教育強(qiáng)國(guó)。不實(shí)現(xiàn)大學(xué)教師有效參與大學(xué)治理,就無(wú)法實(shí)現(xiàn)大學(xué)治理現(xiàn)代化,也就無(wú)法實(shí)現(xiàn)上述兩大發(fā)展目標(biāo)。我國(guó)大學(xué)在建國(guó)之初照搬蘇聯(lián)模式,成為政府機(jī)構(gòu)的附屬機(jī)構(gòu),政府對(duì)于大學(xué)實(shí)行全方位的管控。隨著時(shí)代的發(fā)展進(jìn)步,雖然政府分權(quán)放權(quán)和實(shí)現(xiàn)大學(xué)自主權(quán)作為大學(xué)和學(xué)術(shù)發(fā)展的本質(zhì)需求,越來(lái)越引起廣泛的重視,目前我國(guó)大學(xué)基本建立了黨委領(lǐng)導(dǎo)下的校長(zhǎng)負(fù)責(zé)制,大學(xué)的法人地位和大學(xué)章程建設(shè)也在逐步推進(jìn)。但在大學(xué)內(nèi)部,傳統(tǒng)的科層制管理導(dǎo)致的大學(xué)“行政化”問(wèn)題依然十分嚴(yán)重,而作為大學(xué)治理重要的參與主體——大學(xué)教師參與的狀況卻令人擔(dān)憂。因此,本文以大學(xué)教師參與大學(xué)治理為研究的重點(diǎn),通過(guò)對(duì)我國(guó)政策法規(guī)、S大學(xué)章程等文本中對(duì)于大學(xué)教師的參與權(quán)利、內(nèi)容、途徑等進(jìn)行文本分析和對(duì)S大學(xué)教師參與學(xué)校的治理現(xiàn)狀進(jìn)行問(wèn)卷調(diào)查這兩個(gè)大的方面,來(lái)探究S大學(xué)教師參與大學(xué)治理中存在的問(wèn)題。在國(guó)家政策法律層面,雖然對(duì)于大學(xué)教師參與權(quán)利有一定的保障,但是總體上來(lái)看,未確立大學(xué)教師參與大學(xué)治理的核心主體地位,對(duì)于大學(xué)教師參與大學(xué)治理賦予的權(quán)利范圍較小、內(nèi)容較少,缺乏保障落實(shí)的細(xì)則和措施;在S大學(xué)章程上,照搬國(guó)家已有的政策法律文本居多,切實(shí)深化和細(xì)化的落實(shí)措施少,缺乏大學(xué)教師有效參與決策和監(jiān)督的機(jī)制和組織,也無(wú)法有效保障大學(xué)教師參與權(quán)利的落實(shí)。在S大學(xué)教師參與學(xué)校治理的問(wèn)卷調(diào)查中發(fā)現(xiàn),S大學(xué)教師擁有參與大學(xué)治理的內(nèi)在訴求,但是因?yàn)橹贫、途徑、自身參與意識(shí)和能力等原因,S大學(xué)教師并未有效參與到大學(xué)治理當(dāng)中,且S大學(xué)教師對(duì)于參與的現(xiàn)狀并不滿意。針對(duì)法律政策文本分析以及問(wèn)卷調(diào)查中發(fā)現(xiàn)的問(wèn)題,本文提出了相應(yīng)的建議和對(duì)策措施。一方面,在大學(xué)治理的外部,需要政府進(jìn)一步完善法律政策制度,賦予大學(xué)教師更多且更明確的參與權(quán)利;要合理構(gòu)建政府與大學(xué)之間的關(guān)系,政府合理的分權(quán)和放權(quán),實(shí)現(xiàn)大學(xué)獨(dú)立法人地位和充分的自主權(quán)。這些外部的宏觀政策法律和政校關(guān)系是大學(xué)教師參與大學(xué)治理的外部環(huán)境。另一方面,在大學(xué)內(nèi)部治理當(dāng)中,第一,大學(xué)應(yīng)當(dāng)深化、細(xì)化法律制度文本,構(gòu)建參與機(jī)制和組織,保障大學(xué)教師參與權(quán)利切實(shí)可行;第二,大學(xué)內(nèi)部的治理需進(jìn)一步去“行政化”,提升“學(xué)術(shù)權(quán)利”和“教師權(quán)利”,實(shí)現(xiàn)治理內(nèi)部各主體的權(quán)力均衡、多元互動(dòng)、合作共贏;此外,大學(xué)還需要加強(qiáng)教師參與大學(xué)治理的宣傳,形成良好的教師參與文化氛圍。最后,從大學(xué)教師自身角度來(lái)看,亟需要提高參與大學(xué)治理意識(shí)、提升自身參與能力。
[Abstract]:The participation of university teachers in university governance means that as an important stakeholder in the process of university governance, all the university teachers, including professors and non professorship titles, have legitimate and reasonable reference and rights in the various fields of university teaching, scientific research, personnel and logistics, which can safeguard their own rights and interests and promote the governance of universities. The policy is scientific, democratic and modernized. The program for reform and development of the middle and long term education of the state has been basically modernized by the year 2020. In 2015, the State Council has promoted the overall plan of the construction of world class universities and first-class disciplines by the State Council in 2015. It is impossible to realize the modernization of the university governance without realizing the effective participation of the university teachers in the university governance. The two major development goals can not be realized. In the early days of the founding of the people's Republic of China, the universities of our country copied the Soviet model and became a subsidiary organ of the government institutions. Although the government's decentralization of power and the realization of university autonomy as the essential demand of University and academic development, more and more attention has been paid to it. At present, the university has basically established the principal responsibility system under the leadership of the Party committee, the legal person status of the University and the construction of the University constitution are also progressively advancing. The problem of University "administration" is still very serious, and the participation of university teachers, as an important participant in university governance, is worrying. Therefore, this paper focuses on the participation of university teachers in university governance, and the participation rights of university teachers in the text of China's policies and regulations, the Constitution of S University and so on. The content, the way and so on carries on the text analysis and the questionnaire survey on the present situation of the S University Teachers' participation in the school management, to explore the problems existing in the S University Teachers' participation in the university governance. At the national policy and legal level, although there is a definite guarantee for the rights of the university teachers to participate in the rights, in general, the university has not established the University. Teachers' participation in the core subject of university governance is small, few and lack of detailed rules and measures to ensure the implementation of university governance. In the constitution of S University, the majority of the country's existing policy and legal texts are copied, the practical measures for deepening and refining are few, and the effective participation of university teachers is short. The mechanism and organization of policy and supervision can not effectively guarantee the implementation of the rights of college teachers. In the questionnaire survey on the participation of S teachers in school governance, it is found that the S university teachers have the inherent demand to participate in the university governance. However, because of the system, the way, the consciousness and ability of their own participation, the teachers of the University of S have not been effectively involved in the University. The S university teachers are not satisfied with the present situation of participation. In view of the problems found in the text analysis of the legal policy and the problems found in the questionnaire survey, this paper puts forward the corresponding suggestions and countermeasures. On the one hand, the government needs to further improve the legal policy system and give the university teachers more and more explicit in the outside of the university governance. The relationship between the government and the university should be rationally constructed, the government has the right to decentralization and decentralization, and the independent legal person status and the full autonomy of the university should be realized. The external macro policy law and the political school relationship are the external environment of the University Teachers' participation in the University Governance. Deepening, refining the text of the legal system, constructing the participation mechanism and organization, ensuring the practical feasibility of the participation of the university teachers. Second, the internal governance of the university needs to be further "administrative", to enhance the "academic right" and "teacher rights", to achieve the right to govern the internal rights of the internal bodies of Li Junheng, multi interaction and win-win cooperation; in addition, the university needs also. Strengthen the propaganda of teachers' participation in university governance and form good teachers to participate in the cultural atmosphere. Finally, from the perspective of the university teachers themselves, it is urgent to improve the awareness of participation in university governance and enhance their participation ability.
