【摘要】：當(dāng)代中國(guó)法學(xué)教育面臨困境,這與人們對(duì)"法是什么"的追問(wèn)與回答密切相關(guān),對(duì)"法是什么"的認(rèn)知會(huì)影響和構(gòu)造法學(xué)教育的模式。將法作為階級(jí)斗爭(zhēng)的工具去看待,造就了"政治模式"的法學(xué)教育;將法歸結(jié)為規(guī)則的認(rèn)知,導(dǎo)致了"規(guī)則模式"的法學(xué)教育;而將法看做實(shí)踐智慧,將會(huì)引發(fā)法學(xué)教育模式的根本變革。走向?qū)嵺`智慧,乃是中國(guó)法學(xué)教育改革的基本原則。依據(jù)法作為實(shí)踐智慧的基本判定,則法學(xué)教育的改革可以表現(xiàn)為三個(gè)方面的基本進(jìn)路:法學(xué)教育的人文取向;法學(xué)教育的經(jīng)驗(yàn)維度;法學(xué)教育的道德之維。
[Abstract]:The legal education in contemporary China is faced with difficulties, which is closely related to people's questioning and answering of "what is law". The cognition of "what is law" will influence and construct the mode of law education. The cognition of law as rule leads to the law education of "rule mode"; To regard law as practical wisdom will lead to a fundamental change in the mode of legal education. To move to practical wisdom is the basic principle of the reform of legal education in China, and the basis of law as the basic judgment of practical wisdom. Then the reform of legal education can be manifested as three basic approaches: the humanistic orientation of legal education; The empirical dimension of legal education; The moral dimension of legal education.
