【摘要】:教育治理現(xiàn)代化的法治邏輯意指從法治視角探尋教育治理現(xiàn)代化的基本內(nèi)涵,其實質(zhì)就是回答教育治理現(xiàn)代化的法治目標和教育治理現(xiàn)代化的法治路徑兩個基本問題。探究教育治理現(xiàn)代化法治邏輯對調(diào)節(jié)教育利益關(guān)系、規(guī)范公共教育權(quán)力、推進教育內(nèi)涵式發(fā)展、適應(yīng)教育發(fā)展規(guī)律具有重要意義;诜ㄖ芜壿嬚J識教育治理現(xiàn)代化問題,更關(guān)注教育發(fā)展秩序的優(yōu)先性、治理路徑的可行性、治理方式的規(guī)范性以及治理目標的人本性。遵循教育治理現(xiàn)代化的法治邏輯,要用法治思維深化教育改革,在目標上追求教育制度正義,在著力點平衡教育自由與教育秩序關(guān)系,在落腳點通過教育法治實現(xiàn)教育善治。
[Abstract]:The rule of law logic of educational governance modernization means to explore the basic connotation of educational governance modernization from the perspective of rule of law. Its essence is to answer two basic questions: the goal of the rule of law of the modernization of educational governance and the path of the rule of law of the modernization of educational governance. It is of great significance to standardize the public educational power, to promote the implicit development of education and to adapt to the law of educational development. Based on the logic of rule of law, we should understand the modernization of educational governance and pay more attention to the priority of the order of educational development. The feasibility of the governance path, the standardization of governance mode and the human nature of governance goal. Following the legal logic of modernization of educational governance, we should deepen the educational reform with the rule of law thinking, and pursue the justice of educational system in the goal. To balance the relationship between educational freedom and educational order and to achieve good education governance through educational rule of law.
