【摘要】：隨著經(jīng)濟(jì)全球化發(fā)展和互聯(lián)網(wǎng)應(yīng)用的普及,以互聯(lián)網(wǎng)為載體的溝通交流平臺(tái)大量涌現(xiàn),微信在這種大時(shí)代背景下應(yīng)運(yùn)而生。網(wǎng)絡(luò)言論具有環(huán)境開(kāi)放、主體虛擬化、行為隱蔽和方式多變等特點(diǎn),極易被極端分子利用,淪為惡意誹謗他人、實(shí)施犯罪、傳播色情、甚至宣傳分裂國(guó)家的“競(jìng)技場(chǎng)”。微信作為一種新興的網(wǎng)絡(luò)通訊工具,截止至2015年1月,用戶總數(shù)已經(jīng)超過(guò)6億,使用主體之廣泛、生命力之強(qiáng)大、促進(jìn)社會(huì)經(jīng)濟(jì)發(fā)展之積極意義可見(jiàn)一斑。較之于其他網(wǎng)絡(luò)平臺(tái),微信有著自身的獨(dú)到之處:半封閉性、自我凈化能力差,熟人社會(huì)圈、導(dǎo)向性強(qiáng)等。如何對(duì)微信平臺(tái)中公民言論自由進(jìn)行合理規(guī)制、如何衡平公民言論自由和“網(wǎng)絡(luò)言論暴力”、如何在本人言論自由權(quán)和他人私權(quán)的博弈中尋求平衡點(diǎn)等,都亟待予以解決。本文首先基于“平衡論說(shuō)”的觀點(diǎn)對(duì)微信言論自由的保障進(jìn)行研究,通過(guò)權(quán)衡各類主體的權(quán)利與義務(wù)關(guān)系,最大化的促使現(xiàn)有矛盾向發(fā)展動(dòng)力的轉(zhuǎn)變。只有加強(qiáng)公眾參與、重視發(fā)揮憲法的保障作用、及時(shí)化解矛盾減少?zèng)_突,才能切實(shí)舞好政府監(jiān)管這把雙刃劍;其次,擬通過(guò)研究我國(guó)微信言論的政府監(jiān)管現(xiàn)狀,分析我國(guó)目前微信違法性言論層出不窮的原因;最后提出對(duì)微信言論進(jìn)行政府監(jiān)管的具體完善措施,包括根據(jù)微信言論的不同類型區(qū)分處理、推行微信后臺(tái)實(shí)名制、明確微信言論主體的法律責(zé)任等方面。并提出一些具有方法論指導(dǎo)價(jià)值的思路,以期對(duì)微信言論的政府監(jiān)管制度及相關(guān)實(shí)踐貢獻(xiàn)綿薄之力。
[Abstract]:With the development of economic globalization and the popularization of Internet applications, a large number of communication platforms based on the Internet have emerged. WeChat came into being under the background of this era. Network speech has the characteristics of open environment, subject virtualization, covert behavior and changeable way. It is easy to be used by extremists, to slander others maliciously, to commit crimes, to spread pornography, and even to propagate the "arena" that divides the country. WeChat as a new network communication tool, up to January 2015, the total number of users has exceeded 600 million, the wide range of users, the vitality of the strong, promote the positive significance of socio-economic development can be seen. Compared with other network platforms, WeChat has its own unique features: semi-closed, poor self-purification ability, acquaintance social circle, strong orientation and so on. How to regulate the freedom of speech in WeChat platform, how to balance the freedom of speech and "network violence", how to find a balance between the right to freedom of speech and the private rights of others, and so on, are urgently needed to be solved. First of all, this paper studies the guarantee of WeChat freedom of speech based on the theory of balance. By weighing the rights and obligations of various subjects, this paper maximizes the transformation of existing contradictions to the motive force of development. Only by strengthening public participation, paying attention to the guarantee function of the constitution, resolving conflicts in time and reducing conflicts, can we effectively dance the double-edged sword of government supervision; Secondly, through the study of the status quo of government supervision of WeChat speech in China, this paper analyzes the reasons why illegal WeChat comments emerge in China. Finally, it puts forward specific measures to perfect the government supervision of WeChat speech, including distinguishing and dealing with WeChat speech according to different types of WeChat speech, carrying out the real name system of WeChat backstage, clarifying the legal responsibility of WeChat speech subjects, and so on. It also puts forward some ideas which have the guiding value of methodology in order to contribute a little to the government supervision system and related practice of WeChat speech.
