【摘要】：政府信息公開工作能否發(fā)揮出較好的效果，堅(jiān)實(shí)的理論基礎(chǔ)和必要的法律依據(jù)是必不可少的。同時(shí)，對(duì)于政府信息公開工作而言，它實(shí)際上是社會(huì)發(fā)展的要求，更是構(gòu)建服務(wù)型政府的要求，同樣也是我國(guó)地方政府提升其公信力的關(guān)鍵手段。目前來(lái)說，在全國(guó)范圍內(nèi)，政府信息公開工作已經(jīng)得到了廣泛的開展，并取得了一定的成績(jī)。但是，它也逐漸的暴露出來(lái)了多種問題，帶來(lái)了很多不利的影響。對(duì)于地方政府而言，它與中央政府存在很大的差別，這主要是因?yàn)榈胤秸c公眾利益直接相連，同時(shí)還能對(duì)下級(jí)發(fā)揮示范作用。所以，在政府信息公開這一工作鏈上，地方政府信息公開工作處于一個(gè)極為關(guān)鍵的位置，有必要針對(duì)此問題進(jìn)行深入地研究。因此政府信息公開研究對(duì)于我國(guó)政府機(jī)構(gòu)改革具有重要的理論意義和現(xiàn)實(shí)意義，同時(shí)也能提升政府的公信力。 本文基于此背景，首先對(duì)政府信息公開進(jìn)行了理論分析。對(duì)政府信息公開的相關(guān)概念進(jìn)行了界定，并深入闡述了政府信息公開建設(shè)所必須依據(jù)的原則。政府信息公開對(duì)提高行政效率、實(shí)現(xiàn)信息資源共享、保障公民的知情權(quán)，維護(hù)社會(huì)穩(wěn)定具有重要的意義。政府信息公開的理論基礎(chǔ)有人民主權(quán)理論、公眾參與理論和信息不對(duì)稱理論。 其次，通過對(duì)山西省2008-2013年的信息公開年度報(bào)告進(jìn)行統(tǒng)計(jì)，，以政府信息公開的內(nèi)容、組織與制度以及公開渠道三個(gè)角度回顧了山西省政府信息公開建設(shè)的發(fā)展進(jìn)程，對(duì)山西省政府信息公開的現(xiàn)狀進(jìn)行了深入分析。發(fā)現(xiàn)的問題主要有：一是地方和部門對(duì)政府信息公開的認(rèn)識(shí)不足；二是府信息公開內(nèi)容缺乏統(tǒng)一的規(guī)范標(biāo)準(zhǔn)；三是監(jiān)督和救濟(jì)機(jī)制不完善。其主要原因在于政府官員思想意識(shí)和行政理念滯后、公民權(quán)利意識(shí)的薄弱、制度設(shè)計(jì)上的欠缺、政府信息公開監(jiān)督結(jié)構(gòu)單一。 最后，根據(jù)國(guó)外和我國(guó)其它地區(qū)政府信息公開的經(jīng)驗(yàn)總結(jié)，為山西省推進(jìn)政府信息公開的提出針對(duì)性對(duì)策和建議：轉(zhuǎn)變政府觀念和培育公民的權(quán)利意識(shí)；完善機(jī)制，加強(qiáng)法治和制度創(chuàng)新；健全多元化信息公開評(píng)估主體以及建立科學(xué)的評(píng)估體系來(lái)完善評(píng)估標(biāo)準(zhǔn)。希望本文能夠?qū)ι轿魇∧酥廖覈?guó)的政府信息公開建設(shè)提供有益借鑒。
[Abstract]:Whether the government information disclosure can play a better effect, a solid theoretical basis and necessary legal basis is essential. At the same time, as far as government information disclosure is concerned, it is actually the requirement of social development and the construction of service-oriented government. It is also the key means to enhance the credibility of local governments in China. At present, in the national scope, the government information publicity has been widely carried out, and achieved some achievements. However, it also gradually exposed a variety of problems, resulting in a lot of adverse effects. For the local government, it is very different from the central government, mainly because the local government is directly linked to the public interest, but also can play a model role for the lower level. Therefore, in the working chain of government information disclosure, the work of local government information disclosure is in a very important position, it is necessary to study this problem in-depth. Therefore, the study of government information disclosure has important theoretical and practical significance for the reform of government institutions in our country, and it can also enhance the credibility of the government. Based on this background, this paper first carries on the theoretical analysis to the government information disclosure. This paper defines the relevant concepts of government information disclosure, and expounds the principles on which government information disclosure must be based. The disclosure of government information plays an important role in improving administrative efficiency, sharing information resources, guaranteeing citizens' right to know, and maintaining social stability. The theoretical basis of government information disclosure includes the theory of people's sovereignty, the theory of public participation and the theory of information asymmetry. Secondly, through the statistics of the information disclosure annual report of Shanxi Province from 2008 to 2013, this paper reviews the development process of Shanxi provincial government information disclosure construction from three angles: the content of government information disclosure, organization and system, and open channels. This paper makes a deep analysis on the present situation of Shanxi provincial government's information disclosure. The main problems found are: one is the lack of awareness of the government information disclosure by local authorities and departments; the other is the lack of uniform standard for the content of government information disclosure; the third is the imperfect supervision and relief mechanism. The main reasons are that the ideology and administrative concept of government officials lag behind, the consciousness of citizens' rights is weak, the system design is lacking, and the structure of government information public supervision is single. Finally, based on the experience of government information disclosure in foreign countries and other areas of our country, this paper puts forward some countermeasures and suggestions for Shanxi Province to promote government information disclosure: to change the concept of government and cultivate citizens' awareness of rights; Perfect the mechanism, strengthen the rule of law and institutional innovation, perfect the subject of open evaluation of diversified information and establish a scientific evaluation system to improve the evaluation standards. I hope this paper can provide a useful reference to the construction of government information disclosure in Shanxi Province and even in our country.
