【摘要】：正2016年12月25日,第十二屆全國(guó)人大常委會(huì)第二十五次會(huì)議表決通過(guò)《全國(guó)人民代表大會(huì)常務(wù)委員會(huì)關(guān)于在北京市、山西省、浙江省開(kāi)展國(guó)家監(jiān)察體制改革試點(diǎn)工作的決定》(以下簡(jiǎn)稱(chēng)《決定》),表明試點(diǎn)工作要"為在全國(guó)推進(jìn)國(guó)家監(jiān)察體制改革探索積累經(jīng)驗(yàn)"。這意味著試點(diǎn)地區(qū)的監(jiān)察制度(簡(jiǎn)稱(chēng)"試點(diǎn)制度")設(shè)計(jì)將成為在全國(guó)推進(jìn)這一改革的制度雛形。研讀《決定》規(guī)定的"試點(diǎn)制度"可知,將國(guó)家行政監(jiān)察機(jī)關(guān)升級(jí)為國(guó)家監(jiān)察委員會(huì),形成"一府一委兩院"的權(quán)力架構(gòu),是國(guó)家監(jiān)察體制改革的重要內(nèi)容。分析"試點(diǎn)制度"的權(quán)力配置,可見(jiàn)其重大突破與尚待完善之問(wèn)題。對(duì)于這些突破和問(wèn)題的研究,有助于為完善獨(dú)立、權(quán)威、有地位、受制約、職能配置合理的監(jiān)察體制改革提供參考。
[Abstract]:On December 25, 2016, the 25th meeting of the Twelfth National people's Congress standing Committee voted to approve the decision of the standing Committee of the National people's Congress in Beijing, Shanxi Province, The decision of Zhejiang Province to carry out the pilot work of National Supervision system Reform (hereinafter referred to as "decision") indicates that the pilot work should "accumulate experience for promoting the reform of the national supervisory system throughout the country". This means that the design of the supervision system in the pilot area will become the rudiments of the reform in the whole country. After studying the "pilot system" stipulated in the "decision", we can see that it is an important content of the reform of the state supervisory system to upgrade the state administrative supervisory organ to the state supervisory committee and form a power structure of "one government, one committee, one committee and two houses." By analyzing the power allocation of the pilot system, we can see that its major breakthrough and problems need to be improved. The research on these breakthroughs and problems is helpful to improve the reform of supervision system which is independent, authoritative, stateful, restricted and reasonably allocated.
