【摘要】:改革開放以來,全國性社會組織蓬勃發(fā)展,基本涵蓋了政治、經(jīng)濟(jì)、社會、文化、生態(tài)環(huán)境等各個領(lǐng)域,已經(jīng)成為我國經(jīng)濟(jì)建設(shè)和社會發(fā)展的重要力量,并以其獨(dú)特的地位,在促進(jìn)經(jīng)濟(jì)發(fā)展、繁榮社會事業(yè)、創(chuàng)新社會治理、擴(kuò)大對外交往等方面發(fā)揮了積極作用。與此同時,我國政府對全國性社會組織的管理體制卻相對滯后。全國性社會組織現(xiàn)行管理體制自20世紀(jì)80年代產(chǎn)生以來,隨著國家相關(guān)制度規(guī)定的出臺,也在不斷地完善,但與全國性社會組織的快速發(fā)展相比,還存在黨的領(lǐng)導(dǎo)缺失、注冊登記難度較大、管理責(zé)任界定不清楚、政府支持保障力度不夠、基本法律不健全等問題。這些問題的存在嚴(yán)重影響和制約了全國性社會組織的持續(xù)健康發(fā)展。黨的十八大報告明確提出:“要加快形成政社分開、權(quán)責(zé)明確、依法自治的現(xiàn)代社會組織體制,引導(dǎo)社會組織健康發(fā)展”。2013年,黨的十八屆二中全會和十二屆全國人大一次會議通過的《國務(wù)院機(jī)構(gòu)改革和職能轉(zhuǎn)變方案》提出“改革社會組織管理制度”。2016年8月,中央印發(fā)《關(guān)于改革社會組織管理制度促進(jìn)社會組織健康有序發(fā)展的意見》提出,到2020年,要建立健全統(tǒng)一登記、各司其職、協(xié)調(diào)配合、分級負(fù)責(zé)、依法監(jiān)管的中國特色社會組織管理體制,基本建立政社分開、權(quán)責(zé)明確、依法自治的社會組織制度,基本形成結(jié)構(gòu)合理、功能完善、競爭有序、誠信自律、充滿活力的社會組織發(fā)展格局。一直以來,我國政府對全國性社會組織管理體制高度重視,但由于現(xiàn)行管理體制中的一些問題本身具有的復(fù)雜性和艱巨性等原因,使得全國性社會組織管理體制一直沒有新的進(jìn)展和突破,新的制度規(guī)定落實(shí)方法不多、理論不足、實(shí)踐不夠。本文以我國政府對全國性社會組織管理體制為研究對象,運(yùn)用理論研究法、調(diào)查研究法、比較分析法以及公共管理學(xué)相關(guān)理論,通過走訪調(diào)研登記管理機(jī)關(guān)和業(yè)務(wù)主管部委、訪談全國性社會組織,深入查找全國性社會組織管理體制中存在的問題,認(rèn)真梳理分析產(chǎn)生問題的原因,結(jié)合我國政府對全國性社會組織管理提出的要求和下一步改革方向,借鑒英美、法德等國家的管理經(jīng)驗,研究提出有效解決我國政府對全國性社會組織管理體制問題的方法對策,構(gòu)建以推進(jìn)全國性社會組織與行政機(jī)關(guān)脫鉤為動力,以強(qiáng)化黨的領(lǐng)導(dǎo)為前提,以促進(jìn)全國性社會組織依法自治、誠信經(jīng)營為目的,以加強(qiáng)政府與全國性社會組織合作為主基調(diào),以加強(qiáng)登記管理機(jī)關(guān)和行業(yè)監(jiān)管部門依法行政、綜合監(jiān)管為關(guān)鍵,以完善社會組織法律法規(guī)為保障的,新型管理體制。通過對新型管理體制的研究,進(jìn)一步為我國政府推進(jìn)全國性社會組織管理體制改革提供理論依據(jù),為促進(jìn)全國性社會組織持續(xù)健康發(fā)展提供智力支持。
[Abstract]:Since the reform and opening up, the national social organization has developed vigorously, basically covering the political, economic, social, cultural, ecological environment and other fields, has become an important force in economic construction and social development in China, and with its unique status, It has played a positive role in promoting economic development, prospering social undertakings, innovating social governance and expanding external contacts. At the same time, our government's management system of national social organizations is relatively lagging behind. Since the emergence of the national social organization management system in the 1980s, with the introduction of the relevant national system, it has been constantly improved, but compared with the rapid development of the national social organization, there is still a lack of leadership of the Party. Registration is difficult, management responsibility is not clearly defined, government support is not enough, basic law is not perfect and so on. The existence of these problems has seriously affected and restricted the sustainable and healthy development of national social organizations. The report of the 18th National Congress of the Party clearly stated: "We should accelerate the formation of a modern social organization system that separates government and society, has clear powers and responsibilities, and is autonomous according to law, and guide the healthy development of social organizations." in 2013, The "Plan for Institutional Reform and functional Transformation of the State Council", adopted by the second Plenary session of the 18th CPC Central Committee and the first session of the Twelfth National people's Congress, proposed "reforming the management system of social organizations." in August 2016, The Central Committee issued and published the opinions on the Reform of the Management system of Social organizations to promote the healthy and orderly Development of Social organizations. By 2020, it is necessary to establish and improve unified registration, perform their respective duties, coordinate with each other, and be responsible at various levels. The management system of social organizations with Chinese characteristics, which is supervised by law, basically establishes a system of social organizations with separate administration and social cooperation, clear powers and responsibilities, and autonomy according to law, basically forming a reasonable structure, perfect functions, orderly competition, honesty and self-discipline, A dynamic pattern of social organization development. Our government has always attached great importance to the national social organization management system, but due to the complexity and difficulty of some problems in the current management system, There has been no new progress and breakthrough in the national social organization management system, and there are few methods to implement the new system regulations, insufficient theory and insufficient practice. This article takes our country government to the national social organization management system as the research object, uses the theory research method, the investigation research method, the comparative analysis method and the public management related theory, through the investigation and research registration management authority and the service competent department, Interview with national social organizations, find out in depth the problems existing in the management system of national social organizations, carefully comb and analyze the causes of the problems, and combine the requirements of our government on the management of national social organizations and the direction of the next step of reform. Based on the management experience of Britain, America, France and Germany, the paper puts forward some effective methods and countermeasures to solve the problem of the national social organization management system, and constructs the motive force to promote the decoupling of the national social organization from the administrative organ. On the premise of strengthening the leadership of the Party, in order to promote the national social organizations to be autonomous according to law, to operate in good faith, to strengthen the cooperation between the government and national social organizations, and to strengthen the registration management organs and the administrative departments of industries and supervision departments in accordance with the law, Comprehensive supervision as the key, to improve the laws and regulations of social organizations as a guarantee, a new management system. Through the study of the new management system, it provides the theoretical basis for our government to promote the reform of the national social organization management system, and provides intellectual support for the sustainable and healthy development of the national social organization.
