【摘要】：中國(guó)自由貿(mào)易試驗(yàn)區(qū)的建設(shè),是我國(guó)經(jīng)濟(jì)發(fā)展進(jìn)入新常態(tài)和應(yīng)對(duì)全球經(jīng)濟(jì)體系新一輪調(diào)整所作出的重大戰(zhàn)略部署,也是在擴(kuò)大對(duì)外開(kāi)放和全面深化改革的大背景下,對(duì)我國(guó)行政管理體制創(chuàng)新進(jìn)行的探索。當(dāng)下,政府主導(dǎo)自貿(mào)區(qū)建設(shè),其行政管理體制的創(chuàng)新決定了自貿(mào)區(qū)的制度創(chuàng)新,也影響著自貿(mào)區(qū)的發(fā)展進(jìn)程。對(duì)自貿(mào)區(qū)行政管理創(chuàng)新的研究,是對(duì)我國(guó)自貿(mào)區(qū)制度創(chuàng)新的思考,也是為其他地區(qū)學(xué)習(xí)借鑒自貿(mào)區(qū)探索路徑。自貿(mào)區(qū)行政管理體制創(chuàng)新,本質(zhì)上就是要理順政府與市場(chǎng)關(guān)系,通過(guò)行政體制改革,增強(qiáng)市場(chǎng)活力,促進(jìn)對(duì)外開(kāi)放。具體舉措表現(xiàn)為政府機(jī)構(gòu)設(shè)置和行政架構(gòu)的優(yōu)化,投資貿(mào)易便利化改革和事中事后監(jiān)管制度的完善。本文從國(guó)際先進(jìn)自貿(mào)區(qū)經(jīng)典案例的分析出發(fā),介紹了新加坡、香港和美國(guó)三地自貿(mào)區(qū)建設(shè)和管理狀況,梳理其先進(jìn)經(jīng)驗(yàn),歸納總結(jié)了國(guó)際自貿(mào)區(qū)的普遍特點(diǎn),作為我國(guó)自貿(mào)區(qū)行政管理體制創(chuàng)新的重要借鑒。同時(shí)從管理模式與機(jī)構(gòu)設(shè)置、投資貿(mào)易管理體制和政府監(jiān)管模式三個(gè)方面著手,分析了我國(guó)自貿(mào)區(qū)已有的行政管理體制創(chuàng)新,充分認(rèn)可了“合署辦公”、負(fù)面清單制度、“單一窗口”建設(shè)和事中事后監(jiān)管體系等各項(xiàng)舉措,并在梳理現(xiàn)狀的基礎(chǔ)上尋找存在問(wèn)題,指出了行政架構(gòu)中的層級(jí)約束、“條塊”分割、政出多門(mén)等問(wèn)題,投資貿(mào)易管理體制中存在負(fù)面清單的不足和“單一窗口”建設(shè)的困境,政府監(jiān)管制度中的能力不足和主體單一的問(wèn)題,以及行政管理體制法治保障缺乏的問(wèn)題。最后,依據(jù)問(wèn)題找對(duì)策,對(duì)我國(guó)自貿(mào)區(qū)行政管理體制的進(jìn)一步創(chuàng)新提出了幾點(diǎn)想法,包括優(yōu)化行政架構(gòu),完善負(fù)面清單制度,推進(jìn)建設(shè)“單一窗口”,建立事中事后的綜合監(jiān)管體制,以及構(gòu)建我國(guó)自貿(mào)區(qū)法律體系。
[Abstract]:The construction of China's free trade test area is a major strategic deployment of China's economic development into a new normal state and a new round of adjustment to the global economic system. It is also an exploration of the innovation of China's administrative management system under the background of expanding opening to the outside world and deepening the reform in an all-round way. The innovation of the administrative management system determines the institutional innovation of the free trade area and also affects the development process of the free trade area. The research on the innovation of the administrative management of the free trade area is a reflection on the innovation of the system of the free trade area in China, and it is also a path for learning from the free trade area for other areas. The relations between the government and the market, through the reform of the administrative system, enhance the vitality of the market and promote the opening to the outside world. The concrete measures are the optimization of the establishment of government institutions and the administrative structure, the reform of the facilitation of investment and trade and the perfection of the supervision system after the event. This article introduces Singapore, Hongkong and the United States from the analysis of the classic cases in the international advanced free trade area. The state of building and management of the three country free trade area, combing its advanced experience, summarizing the general characteristics of the international free trade area, as an important reference for the innovation of the administrative management system in the free trade area of China. At the same time, starting from the three aspects of the management mode and organization, the management system of investment and trade and the mode of government supervision, we have analyzed the free trade area of our country. Some administrative system innovation, fully recognized the "Office of the joint office", the negative list system, the "single window" construction and the event supervision system, and other measures, and on the basis of combing the status of the existing problems, pointed out the administrative structure of the hierarchical constraints, "bar" division, many political problems, investment trade management. The shortage of negative list in the system and the dilemma of "single window" construction, the lack of ability and the single subject in the government supervision system, and the lack of the rule of law guarantee in the administrative system. Finally, some ideas are put forward to the further innovation of the administrative system of our country's free trade area according to the problems. To optimize the administrative structure, to improve the negative list system, to promote the construction of a single window, to establish a comprehensive supervision system after the event, and to build the legal system of China's free trade area.
