中國(guó)政府監(jiān)管失效的因素模型構(gòu)建研究——基于扎根理論的分析

【摘要】:運(yùn)用扎根理論方法,對(duì)L省的7個(gè)門(mén)類12個(gè)監(jiān)管部門(mén)人員進(jìn)行了深入的訪談與調(diào)研,以訪談筆記作為基礎(chǔ)研究資料,用編碼形式歸納總結(jié)出影響監(jiān)管人員行為的6個(gè)重要因素,分別是制度因素、利益與權(quán)力因素、監(jiān)管部門(mén)因素、監(jiān)管過(guò)程因素、公共監(jiān)督因素和社會(huì)環(huán)境因素。依此構(gòu)建監(jiān)管行為影響因素模型,并對(duì)模型進(jìn)行理論闡釋,提出完善法律法規(guī)、對(duì)監(jiān)管部門(mén)行政首長(zhǎng)的權(quán)力進(jìn)行控制和監(jiān)督、強(qiáng)化公共監(jiān)督的作用,加強(qiáng)對(duì)社會(huì)輿論監(jiān)督的保護(hù)、重視培養(yǎng)監(jiān)管部門(mén)內(nèi)部的傳承、強(qiáng)化監(jiān)管人員行政責(zé)任等對(duì)策,以期提高政府監(jiān)管效率。
[Abstract]:Using the method of rooted theory, the author conducted in-depth interview and investigation on 12 supervisory departments of 7 categories in L province. Taking the interview notes as the basic research materials, the author summed up six important factors that affect the behavior of the supervisors by coding. They are institutional factors, interests and power factors, regulatory factors, regulatory process factors, public supervision factors and social environmental factors. To improve laws and regulations, to control and supervise the power of the executive heads of regulatory departments, to strengthen the role of public supervision, to strengthen the protection of public opinion supervision, and to attach importance to fostering the internal inheritance of the regulatory authorities. Strengthen the administrative responsibility of supervisors and other countermeasures in order to improve the efficiency of government supervision.
