鄰避沖突的多元治理機(jī)制研究

【摘要】:隨著社會(huì)的轉(zhuǎn)型發(fā)展,我國(guó)進(jìn)入社會(huì)矛盾高發(fā)期,社會(huì)風(fēng)險(xiǎn)增加,社會(huì)問(wèn)題凸顯,以鄰避沖突為代表的社會(huì)沖突尤為顯著。一方面,城市居民數(shù)量的增多和消費(fèi)水平的提升對(duì)公共服務(wù)設(shè)施產(chǎn)生了大量的需求;另一方面,垃圾處理廠(chǎng)、發(fā)電廠(chǎng)等公共服務(wù)設(shè)施在滿(mǎn)足社會(huì)公共服務(wù)需求的同時(shí),卻因其產(chǎn)生的負(fù)外部效應(yīng)而遭到周邊居民的聯(lián)合抵制,甚至引發(fā)大規(guī)!吧⒉健被顒(dòng),這種此起彼伏的群體性事件沖擊著政府的合法性基礎(chǔ),嚴(yán)重威脅著社會(huì)穩(wěn)定。鄰避沖突爆發(fā)的直接原因在于鄰避設(shè)施本身的負(fù)外部性和成本效益分布不均衡,但根源卻是各種社會(huì)因素綜合作用的結(jié)果,如政府決策封閉、企業(yè)監(jiān)管不足、公民社會(huì)參與缺失等,其過(guò)程涉及多元利益相關(guān)者,具有社會(huì)復(fù)雜性,需要多元主體共同參與治理。本文正是基于上述現(xiàn)實(shí)背景,從多元治理的視角對(duì)我國(guó)鄰避沖突進(jìn)行研究。本文第一部分是緒論,主要針對(duì)該選題的背景、研究意義、研究思路和研究方法進(jìn)行闡述,總結(jié)國(guó)內(nèi)外鄰避沖突多元治理的研究現(xiàn)狀并加以評(píng)述。第二部分是論文的基礎(chǔ)部分,主要闡述鄰避設(shè)施、鄰避情結(jié)和鄰避沖突的基礎(chǔ)概念,并概述鄰避沖突多元治理的理論基礎(chǔ)和現(xiàn)實(shí)基礎(chǔ),為進(jìn)一步研究塑造理論基奠和現(xiàn)實(shí)背景。第三部分主要運(yùn)用實(shí)證分析的方法研究鄰避沖突的特征和形成原因,基于典型案例統(tǒng)計(jì)數(shù)據(jù)總結(jié)出我國(guó)鄰避沖突的特征,基于問(wèn)卷調(diào)查、量化分析和實(shí)地訪(fǎng)談結(jié)果總結(jié)出我國(guó)鄰避沖突產(chǎn)生的原因。第四部分通過(guò)分析我國(guó)三起典型鄰避沖突的治理過(guò)程,了解多元主體在治理中的行為表現(xiàn),總結(jié)目前我國(guó)鄰避沖突的治理困境,點(diǎn)明問(wèn)題所在。第五部分是對(duì)發(fā)達(dá)國(guó)家和地區(qū)鄰避沖突治理經(jīng)驗(yàn)的探討,總結(jié)成功經(jīng)驗(yàn)對(duì)我國(guó)的啟發(fā),為我國(guó)鄰避沖突多元治理提供參考價(jià)值。第六部分重點(diǎn)探討鄰避沖突多元治理機(jī)制的構(gòu)建。首先基于多中心治理思想,明確多元主體(政府、公民、企業(yè)、社會(huì)組織、媒體和專(zhuān)家)在鄰避沖突治理中的角色和關(guān)系;最后針對(duì)我國(guó)鄰避沖突治理困境,結(jié)合境外成功經(jīng)驗(yàn),提出鄰避沖突多元治理機(jī)制的具體構(gòu)建。本文采用多方法和多層面結(jié)合的形式進(jìn)行分析,希望研究更具系統(tǒng)性和現(xiàn)實(shí)價(jià)值。
[Abstract]:With the social transformation and development, China has entered a period of high social contradictions, social risks increased, social problems highlighted, especially the social conflicts represented by neighboring conflict avoidance. On the one hand, On the other hand, the public service facilities such as garbage treatment plants, power plants and other public service facilities meet the needs of social public services at the same time. However, because of its negative external effects, it has been boycotted by the residents around it, and even triggered large-scale "walking" activities. This kind of mass incidents have impacted the legitimacy foundation of the government. The immediate cause of the outbreak of conflict is the negative externality and the uneven distribution of cost-effectiveness of the adjacent facilities themselves, but the root causes are the combined effects of various social factors, such as the closure of government decision-making, The enterprise supervision is insufficient, the civil society participation is missing, its process involves the multiple stakeholders, has the social complexity, needs the multiple subjects to participate in the governance together. This article is based on the above realistic background, The first part of this paper is the introduction, which mainly focuses on the background, significance, research ideas and research methods of this topic. The second part is the basic part of the thesis, which mainly expounds the basic concepts of adjacent avoidance facilities, adjoining avoidance complex and neighbor avoiding conflict. In order to further study and shape the theoretical foundation and realistic background, the third part mainly uses the method of empirical analysis to study the characteristics and causes of conflict avoidance. Based on the statistical data of typical cases, the characteristics of conflict avoidance in China are summarized. The results of quantitative analysis and field interviews sum up the causes of conflict avoidance in China. Part 4th analyzes the governance process of three typical conflict avoidance cases in China to understand the behavior of multiple subjects in governance. This paper summarizes the difficulties of conflict avoidance in our country and points out the problem. Part 5th discusses the experiences of conflict avoidance in developed countries and regions, and summarizes the inspiration of successful experiences to our country. Part 6th focuses on the construction of multi-governance mechanism of adjacent conflict avoidance. Firstly, based on the idea of multi-center governance, it is clear that the multi-subject (government, citizen, enterprise, social organization), the government, the citizen, the enterprise, the social organization, the government, the citizen, the enterprise and the social organization. The role and relationship of the media and experts in conflict avoidance governance; finally, aiming at the dilemma of conflict avoidance governance in China, combining with the successful overseas experience, This paper proposes the concrete construction of the multivariate governance mechanism of neighbor conflict avoidance. This paper uses multi-method and multi-level combination to analyze, hoping that the research will be more systematic and practical value.
