【摘要】：法治思維是人依據(jù)法律規(guī)則、法律原則和法治精神,依據(jù)一定的邏輯,分析問題、解決問題的思維模式。行政機關(guān)基層公務(wù)員作為國家行政權(quán)力的執(zhí)行者、與社會公眾最直接的接觸者,在行政過程中其法治素質(zhì)的高低關(guān)乎政府的形象,關(guān)乎法治政府的建設(shè)水平。然而,當(dāng)前行政機關(guān)基層公務(wù)員群體中,仍然存在人治觀念根深蒂固漠視行政中的法律效果、權(quán)力思維盛行破壞法治環(huán)境、服務(wù)觀念缺失行政效率低下的現(xiàn)象,因此有必要對基層公務(wù)員進行法治思維的培養(yǎng)。培養(yǎng)公務(wù)員的法治思維,不僅應(yīng)當(dāng)通過提高公務(wù)員準入的法律素質(zhì)門檻、增強培訓(xùn)、在考核中增加法治思維內(nèi)容的考核等,以提高基層公務(wù)員的法律素質(zhì);而且需要通過建設(shè)行政機關(guān)內(nèi)部的法治環(huán)境和社會法治環(huán)境,來構(gòu)建公務(wù)員法治思維培養(yǎng)的法治環(huán)境;另外,基層公務(wù)員法治思維的培養(yǎng)也需要在立法、司法的環(huán)節(jié)為其提供基礎(chǔ),完善公務(wù)員法治思維培訓(xùn)制度,并通過考核與獎懲檢驗和保障法治思維培養(yǎng)的效果。做到以上的要求,才能培養(yǎng)基層公務(wù)員的法治思維,進而有利于行政機關(guān)基層公務(wù)員自身建設(shè)、有利于法治政府的建設(shè)、有利于國家法治一體化建設(shè)。
[Abstract]:The thinking of rule by law is the mode of thinking that people think according to legal rules, legal principles and spirit of rule of law, according to certain logic, analyzing problems and solving problems. The most direct contact with the public is that the quality of the rule of law in the administrative process is related to the image of the government and the level of construction of the government ruled by law. There still exists the phenomenon of deep-rooted disregard of the legal effect in administration, the prevalence of power thinking, the destruction of the environment of rule by law and the lack of administrative efficiency in the concept of "rule of man". Therefore, it is necessary to train grass-roots civil servants' thinking on the rule of law. In order to cultivate civil servants' legal thinking, we should not only raise the threshold of civil servants' access to the law, enhance training, and increase the examination of the contents of the rule of law thinking in the examination, etc. In order to improve the legal quality of civil servants at the grass-roots level; moreover, it is necessary to build the legal environment for civil servants to train their thinking on the rule of law by building the environment of the rule of law within the administrative organs and the environment of the rule of law in society. The cultivation of grass-roots civil servants' thinking on the rule of law also needs to provide the foundation for it in the process of legislation and administration of justice, to perfect the training system of civil servants' thinking on the rule of law, and to ensure the effect of the cultivation of the thinking of rule of law through examination, reward and punishment, so as to achieve the above requirements. Only in this way can we cultivate the thinking of ruling by law of the civil servants at the grass-roots level, which is conducive to the self-construction of the civil servants at the grass-roots level in administrative organs, to the construction of the government ruled by law and to the integration of
