【摘要】：十八屆三中中全會(huì)的召開及《中共中央關(guān)于全面深化改革若干重大問題的決定》的通過,標(biāo)志著我國(guó)改革開放事業(yè)進(jìn)入了一個(gè)新的篇章�！稕Q定》要求“緊緊圍繞使市場(chǎng)在資源配置中起決定性作用深化經(jīng)濟(jì)體制改革”。十二屆全國(guó)人大一次會(huì)議明確提出了現(xiàn)代社會(huì)組織體制形成的時(shí)間表,即在2017年以前形成政社分開、權(quán)責(zé)明確、依法自治的現(xiàn)代社會(huì)組織體制。政府對(duì)市場(chǎng)和社會(huì)的認(rèn)識(shí)更加清晰,對(duì)自身的定位也更趨準(zhǔn)確。政府職能轉(zhuǎn)變“必須處理好政府與市場(chǎng)、政府與社會(huì)的關(guān)系”,要“更好發(fā)揮社會(huì)力量在管理社會(huì)事務(wù)中的作用”。近些年來,政府也提出向社會(huì)組織購(gòu)買公共服務(wù)。在這樣的背景下,政府將職能轉(zhuǎn)移到誰手里,向誰購(gòu)買公共服務(wù)?這些問題需要我們思考。作為政府與市場(chǎng)之間的中介組織,商會(huì)是我國(guó)迄今為止發(fā)展最為充分的社會(huì)組織,在承接政府職能轉(zhuǎn)移和提供公共服務(wù)方面具有可能性。由商會(huì)參與公共服務(wù)的提供,能幫助實(shí)現(xiàn)政府職能轉(zhuǎn)移。同時(shí),商會(huì)更加了解市場(chǎng)的情況和公眾的需要,商會(huì)在提供俱樂部產(chǎn)品和行業(yè)公共產(chǎn)品上具有優(yōu)勢(shì),因此,由商會(huì)提供這兩種類型的服務(wù)更能滿足市場(chǎng)需要。所以本文提出了商會(huì)提供公共服務(wù)這一研究主題。期望通過這一研究,能為商會(huì)公共服務(wù)功能的更好發(fā)揮提供一些建議。本文主要的研究?jī)?nèi)容如下：首先,從現(xiàn)代社會(huì)公共服務(wù)供給的基本架構(gòu)出發(fā),研究商會(huì)可以提供哪種類型的公共服務(wù),進(jìn)而總結(jié)出我國(guó)商會(huì)提供公共服務(wù)的范圍。然后,考察實(shí)踐運(yùn)行中商會(huì)提供公共服務(wù)的具體情況�？偨Y(jié)我國(guó)商會(huì)公共提供服務(wù)取得的成就,目前存在的問題及問題形成原因。最后,探討以什么樣的機(jī)制來保障我國(guó)商會(huì)更好地提供公共服務(wù)功能。通過研究,本文得出了如下研究結(jié)論：第一,從理論層面分析,需要商會(huì)這樣的組織參與公共服務(wù)的供給。商會(huì)在俱樂部產(chǎn)品和行業(yè)公共產(chǎn)品的提供上具有比較優(yōu)勢(shì),因此,這兩類公共服務(wù)適合由商會(huì)來提供。第二,從實(shí)踐層面分析,在參與公共服務(wù)的供給上,各地商會(huì)進(jìn)行了一定的探索,取得了一些成就和經(jīng)驗(yàn)。從整體上看,目前,我國(guó)商會(huì)公共服務(wù)功能發(fā)揮的還不充分,還有很大提升的空間。需要進(jìn)行機(jī)制創(chuàng)新,政府要對(duì)自身職責(zé)進(jìn)行合理明確定位,完善對(duì)商會(huì)的管理方式,為商會(huì)的發(fā)展創(chuàng)設(shè)良好的制度和法律環(huán)境。商會(huì)也要完善內(nèi)部治理機(jī)制,壯大組織力量,從而保障自身公共服務(wù)功能得到良好發(fā)揮。對(duì)于公共服務(wù)的供給,政府與商會(huì)要秉持公共利益這一立足點(diǎn),在長(zhǎng)期的博弈過程中形成良好的合作互動(dòng)關(guān)系。

The "decision" requires "closely surrounding the decisive role of the market in the allocation of resources to deepen the reform of the economic system." the first session of the 12 National people's Congress clearly put forward. The timetable for the formation of the modern social organization system, That is to say, before 2017, the government formed a modern social organization system with separate government and society, with clear powers and responsibilities, and autonomy according to law. The government has a clearer understanding of the market and society. The transformation of government functions "must handle the relationship between the government and the market and between the government and society" and "give better play to the role of social forces in the management of social affairs". The government also proposes to purchase public services from social organizations. In this context, who will the government transfer its functions to and from whom will it purchase public services? As an intermediary between the government and the market, the Chamber of Commerce is by far the most fully developed social organization in China. It is possible to undertake the transfer of government functions and the provision of public services. Participation of chambers of commerce in the provision of public services can help to achieve the transfer of government functions. At the same time, chambers of commerce have a better understanding of the market situation and the needs of the public, The Chamber of Commerce has an advantage in providing club products and industry public goods, so, The two types of services provided by the Chamber of Commerce can better meet the needs of the market. Therefore, this paper puts forward the research topic of providing public services by the Chamber of Commerce. The main research contents of this paper are as follows: first of all, from the basic structure of the public service supply in modern society, the author studies what kind of public service can be provided by the chamber of commerce. Then it summarizes the scope of the public service provided by the Chamber of Commerce in China. Then, it investigates the concrete situation of the public service provided by the Chamber of Commerce in practice, and sums up the achievements of the public service provided by the Chamber of Commerce in our country. Finally, it discusses the mechanism to ensure the chamber of commerce in our country to provide better public service function. Through the research, this paper draws the following conclusions: first, from the theoretical level analysis, Organizations such as chambers of commerce are required to participate in the supply of public services. Chambers of commerce have comparative advantages in the provision of club products and industrial public goods. Therefore, these two types of public services are suitable to be provided by chambers of commerce. In terms of participation in the supply of public services, local chambers of commerce have made certain explorations and made some achievements and experiences. On the whole, at present, the public service functions of Chinese chambers of commerce have not been given full play. There is still a lot of room for improvement. There is a need for mechanism innovation. The government should make a reasonable and clear position of its own responsibilities and improve its management of the Chamber of Commerce. To create a good system and legal environment for the development of the Chamber of Commerce. The Chamber of Commerce should also improve the internal governance mechanism and strengthen the organizational strength so as to ensure that its public service function can be well brought into play. The government and the chamber of commerce should hold the standpoint of public interest and form good cooperation and interaction in the long-term game process.
