摘要：

《行政復(fù)議法》頒布10余年來(lái)，我國(guó)行政復(fù)議制度成績(jī)斐然，但是通過(guò)與英國(guó)的行政裁判所、美國(guó)的行政法法官、法國(guó)和德國(guó)的行政法院、韓國(guó)和我國(guó)臺(tái)灣地區(qū)的行政復(fù)議委員會(huì)等域外的與行政復(fù)議功能近似制度的比較可以發(fā)現(xiàn)，我國(guó)行政復(fù)議的優(yōu)勢(shì)和潛力還遠(yuǎn)遠(yuǎn)沒(méi)有發(fā)揮出來(lái)。要充分發(fā)揮行政復(fù)議機(jī)制、制度上的優(yōu)勢(shì)，完善我國(guó)的行政復(fù)議制度，使行政復(fù)議成為解決我國(guó)行政爭(zhēng)議的主渠道。

Abstract： 

Administrative Reconsideration Law of The People＇s Republic of China granted more than 10 years ago, and it has has achieved remarkable successes. But there are still some deficiencies especially when compared with the system of administrative tribunals in England, the administrative law judge in the United States, the administrative court institution in France and Germa- ny, the administrative reconsideration committee in South Korea and Taiwan. So it is necessary to play the advantage and perfect the administrative reconsideration, and construct it into the the main channel to settle the administrative disputes.
