【摘要】：自多哈回合開始,貿(mào)易便利化就一直是焦點所在,從“過境制度”、“進(jìn)出口規(guī)費與手續(xù)”和“貿(mào)易法規(guī)”等措施到系統(tǒng)的歐盟電子海關(guān)、AEO制度和層次報關(guān)制度；再至美國便捷通關(guān)制度、貨物分類制度和庫存控制和簿記制度(ICRS):以及新加坡的關(guān)稅制度、網(wǎng)絡(luò)平臺和物流制度的建設(shè),貿(mào)易便利化在世界范圍內(nèi)己占據(jù)越來越重要的位置,同時如何對其更進(jìn)一步完善也是便利化進(jìn)程中不得不面對的難題。中國是WTO的一員,推進(jìn)其貿(mào)易便利化進(jìn)程既是其條約義務(wù),也是其進(jìn)一步承接世界經(jīng)濟(jì)轉(zhuǎn)移的剛性需求。為此,海關(guān)特殊監(jiān)管區(qū)域以更為便利的保稅加工運(yùn)輸和儲藏形式充分發(fā)揮其優(yōu)勢,但同時也無法避免其本身缺陷帶來的負(fù)面影響。之后,更加開放、便利的上海自貿(mào)區(qū)在承接海關(guān)特殊監(jiān)管區(qū)域制度、區(qū)位優(yōu)勢的基礎(chǔ)上,除了在實質(zhì)內(nèi)容上展示貿(mào)易自由之外,也向我們展現(xiàn)出其在貿(mào)易便利化進(jìn)程中的無限潛力,但同時不得不面對便利化制度建設(shè)方面的困境,其制度體系如何,如何構(gòu)建,具體制度有哪些漏洞,以及應(yīng)當(dāng)怎樣彌補(bǔ)漏洞,這些都是上海自貿(mào)區(qū)貿(mào)易便利化制度發(fā)展應(yīng)當(dāng)解決的首要問題。為此,在深刻分析、辯證吸收已有建設(shè)成果的基礎(chǔ)上,創(chuàng)新自貿(mào)區(qū)便利化制度,構(gòu)架自貿(mào)區(qū)便利化體系框架具有深遠(yuǎn)意義。本文采用了多種寫作方法,有歷史分析、對比分析、歸納總結(jié)等,意在對上海自貿(mào)區(qū)作整體便利化制度建設(shè),也為中國全面提高便利化水平提供模板和經(jīng)驗。
[Abstract]:Since the Doha Round, trade facilitation has been the focus, from measures such as "transit system", "import and export fees and procedures" and "trade regulations" to the systematic EU electronic customs AEO system and hierarchical customs declaration system; And then to the convenient customs clearance system in the United States, the goods classification system and the inventory control and bookkeeping system, as well as the construction of the tariff system, the network platform and the logistics system in Singapore, trade facilitation has occupied an increasingly important position in the world. At the same time, how to further improve it is also a difficult problem in the process of facilitation. China is a member of the WTO, and promoting its trade facilitation process is not only its treaty obligation, It is also a rigid demand for its further undertaking of world economic transfers. To this end, special customs supervision areas have fully developed their advantages in the form of more convenient bonded processing, transportation and storage. However, at the same time, it is also impossible to avoid the negative impact of its own defects. After that, the more open and convenient Shanghai Free Trade Zone, on the basis of accepting the regional system of special customs supervision and location advantages, in addition to demonstrating the freedom of trade in substance, It also shows us its unlimited potential in the process of trade facilitation, but at the same time it has to face the difficulties in the construction of the facilitation system, how and how to build the system, and what are the loopholes in the specific system. And how to make up for the loopholes, these are the most important problems that should be solved in the development of the trade facilitation system of the Shanghai Free Trade Zone. Therefore, on the basis of profound analysis and dialectical absorption of the existing construction achievements, we should innovate the facilitation system of the free trade zone. It is of profound significance to set up the framework of the free trade area facilitation system. This paper adopts various writing methods, including historical analysis, comparative analysis, summary and so on, in order to build the overall facilitation system of Shanghai free trade area. It also provides a template and experience for China to comprehensively improve its facilitation level.
