論我國食品安全中的政府責(zé)任

【摘要】:“民以食為天”,食物是我們維持生命的物質(zhì)基礎(chǔ),是我們生產(chǎn)生活中最跟本的需求。近幾年來,食品安全事件頻頻發(fā)生,使人們“談食色變”,這直接影響了我國政府的公信力和社會穩(wěn)定。然而,諸如“蘇丹紅”事件、“三鹿三聚氰胺奶粉”事件、“雙匯瘦肉精”事件、“塑化劑”事件、“黑心地溝油”事件以及“皮革奶”等等事件的出現(xiàn),表明食品安全問題已經(jīng)不是單純的個(gè)案,這關(guān)系到整個(gè)食品行業(yè)的健康發(fā)展。由此,食品安全問題引起了社會的廣泛討論和關(guān)注,并且,對于這個(gè)問題的解決需要擺在重要議程,食品安全問題的解決直接關(guān)系到和諧社會、民主社會、責(zé)任政府的建設(shè)。 目前,對于政府責(zé)任方面的研究很多,但從食品安全視角對政府責(zé)任的研究卻很少。在民主政治背景下,以及高度復(fù)雜性和高度不確定性時(shí)代特征下,政府雖然已經(jīng)做出行動(dòng),但眾多食品安全事件的發(fā)生,筆者認(rèn)為主要原因仍在于政府責(zé)任的履行不到位。 政府責(zé)任履行不到位的原因是多方面的,如職能交叉、政府的缺位越位等。本文主要以利益分析為出發(fā)點(diǎn)進(jìn)行原因分析,從政府責(zé)任角度提出加強(qiáng)政府責(zé)任的重要性。筆者認(rèn)為,盡管我國已經(jīng)制定了詳盡的規(guī)章制度,政府責(zé)任履行不到位的主要原因在于對這些規(guī)章制度的執(zhí)行乏力。因此,本文提出要以服務(wù)型政府、責(zé)任政府為理論依據(jù),從完善政府職能、加強(qiáng)責(zé)任人員的處罰力度、剪斷執(zhí)法個(gè)人利益行為幾方面入手,從公共利益出發(fā),提出我國政府要完善行政問責(zé)制度,明確政府責(zé)任定位、確定部門責(zé)任、破除地方保護(hù),同時(shí)應(yīng)培養(yǎng)公民權(quán)利意識、引導(dǎo)食品企業(yè)健康發(fā)展等。以期我國政府能順應(yīng)社會變化,及時(shí)、靈活的調(diào)整食品安全方面的責(zé)任,使得公眾吃得放心,經(jīng)濟(jì)又好又快發(fā)展。
[Abstract]:Food is the material basis of our life and the most essential demand in our production and life. In recent years, food safety incidents occurred frequently, which made people talk about food color change, which directly affected the credibility of our government and social stability. However, incidents such as "Sudan Red", "Sanlu melamine milk powder", "Shuanghui lean meatine", "plasticizer", "black heart gutter oil" and "leather milk" occurred. It shows that food safety is not a simple case, which is related to the healthy development of the whole food industry. Therefore, the food safety problem has aroused the widespread discussion and the attention of the society, moreover, the solution to this problem needs to be placed on the important agenda, the food safety question solution is directly related to the harmonious society, the democratic society, the responsible government construction. At present, there are a lot of researches on government responsibility, but there are few researches on government responsibility from the perspective of food safety. Under the background of democratic politics and the characteristics of highly complex and uncertain times, although the government has taken action, but many food safety incidents occurred, I think the main reason is that the implementation of government responsibility is not in place. There are many reasons why the government's responsibility is not fulfilled, such as the overlapping of functions, the absence of government offside and so on. Based on the analysis of interests, this paper puts forward the importance of strengthening government responsibility from the angle of government responsibility. The author thinks that although our country has formulated detailed rules and regulations, the main reason why the government's responsibility is not fulfilled is that the enforcement of these rules and regulations is weak. Therefore, based on the theory of service-oriented government and responsible government, this paper proposes to improve the functions of the government, strengthen the punishment of the responsible personnel, cut off the individual interests of law enforcement, and proceed from the public interest. It is suggested that our government should perfect the system of administrative accountability, define the position of government responsibility, determine the responsibility of departments, break down the local protection, at the same time, train the consciousness of civil rights and guide the healthy development of food enterprises, etc. Hope our government can adapt to the social changes, timely, flexible adjustment of food safety responsibilities, so that the public can eat safely, the economy is good and rapid development.
