【摘要】：食品是人類賴以生存和發(fā)展最基本物質(zhì)的條件。同時食品安全問題既關(guān)系到全民身體健康,又關(guān)系到社會的和諧發(fā)展,更關(guān)系到社會人民對政府部門領(lǐng)導(dǎo)能力的信心。隨著我國經(jīng)濟的發(fā)展,人民群眾生活水平的不斷提高,對日常飲食品質(zhì)的要求也越來越高。然而,近年來接連不斷地發(fā)生食品安全事故,公眾的食品安全感急劇下降。像近幾年出現(xiàn)的“三鹿毒奶粉”、“地溝油”、“瘦肉精”等食品安全事件,不但嚴重威脅著老百姓的生命健康,而且也突顯了我國食品安全監(jiān)管的各種問題。隨著各類食品安全事故的不斷出現(xiàn),食品安全問題逐漸得到人們的關(guān)注,日益成為急需解決的熱點問題。從某種程度上理解,食品安全可定義為一項公共產(chǎn)品,政府有責(zé)任和義務(wù)保障食品的整體質(zhì)量和安全。就目前的情況來看,盡管各級政府做出巨大努力,卻沒有得到預(yù)期的效果。究其根源不僅限于食品生產(chǎn)經(jīng)營者的自利行為或政府部門人員的監(jiān)管不力,其深層次原因植根于食品安全監(jiān)管體制的問題。因此,應(yīng)從保障公眾生命健康權(quán)的高度,率先推動關(guān)于食品安全監(jiān)管的研究,通過制定相關(guān)法律、法規(guī)與措施,試圖建立一套“從農(nóng)田到餐桌”覆蓋生產(chǎn)經(jīng)營全過程的監(jiān)管流程。探索一整套運行有效適合本國國情的食品安全監(jiān)管體制。 鑒于此,從食品安全政府監(jiān)管的相關(guān)理論依據(jù)入手,在對國內(nèi)外有關(guān)食品安全監(jiān)管的研究進行綜述的基礎(chǔ)上,運用比較分析、規(guī)范研究與實證研究相結(jié)合、文獻研究、定性研究與定量研究相結(jié)合等方法,研究我國地方政府食品安全監(jiān)管的現(xiàn)狀,發(fā)現(xiàn)我國地方政府食品安全存在食品安全監(jiān)管中主體不健全、食品安全監(jiān)管中制度不夠完善、食品安全監(jiān)督、檢驗檢測技術(shù)比較落后、地方政府受利益驅(qū)使對監(jiān)管對象打擊不力等存在具體問題,探究了存在問題及其成因,進而提出對策與建議。首先從地方政府食品安全監(jiān)管的相關(guān)概念進行界定,歸納出食品安全政府監(jiān)管的相關(guān)理論基礎(chǔ)。其次,對我國地方政府食品安全監(jiān)管已取得的成績進行總結(jié)。通過研究分析得出我國地方政府食品安全監(jiān)管存在的問題。最后,通過如何加強地方政府食品安全監(jiān)管的對策以及政府完善監(jiān)管的視角,提出應(yīng)在借鑒國外先進的食品安全管理模式和方法的基礎(chǔ)上,結(jié)合中國具體國情,建立具有中國特色的食品安全監(jiān)管體系,強化食品安全法律法規(guī)和標(biāo)準(zhǔn)體系的完善。結(jié)合地方政府食品安全監(jiān)管的實際情況,探討政府加強食品安全監(jiān)管的有效途徑。
[Abstract]:Food is the most basic material condition for human survival and development. At the same time, the problem of food safety is not only related to the health of the whole people, but also to the harmonious development of the society, and also to the confidence of the people in the leadership of government departments. With the development of economy and the improvement of people's living standard, the quality of daily diet is becoming more and more important. However, in recent years, food safety accidents have occurred one after another, and the food safety of the public has declined sharply. Food safety incidents such as "Sanlu Milk Milk", "gutter oil" and "lean meat essence" in recent years not only seriously threaten the lives and health of the common people, but also highlight the problems of food safety supervision in China. With the emergence of various kinds of food safety accidents, people pay more and more attention to the problem of food safety, which has become a hot issue that needs to be solved. To some extent, food safety can be defined as a public good, and the government has the responsibility and obligation to ensure the overall quality and safety of food. As things stand, government efforts at all levels have failed to produce the desired results. The root cause is not only the self-interest behavior of food producers or operators or the ineffective supervision of government personnel, but also rooted in the problem of food safety supervision system. Therefore, we should take the lead in promoting research on food safety supervision from the perspective of safeguarding the public's right to life and health, and adopt relevant laws, regulations and measures. An attempt to establish a "farm-to-table" covering the entire process of production and management regulatory process. To explore a set of effective food safety regulatory system suitable for national conditions. In view of this, starting from the relevant theoretical basis of food safety government supervision, on the basis of summarizing the research on food safety supervision at home and abroad, using comparative analysis, combining normative research with empirical research, literature research, Combining qualitative research with quantitative research, this paper studies the current situation of food safety supervision by local government in China, and finds out that the main body of food safety supervision in local government is not perfect, and the system in food safety supervision is not perfect. There are some specific problems in food safety supervision, inspection and detection technology, and the local government being driven by interests to crack down on the supervising object. The problems and their causes are probed into, and the countermeasures and suggestions are put forward. Firstly, the related concepts of food safety supervision by local governments are defined, and the relevant theoretical basis of food safety supervision is summarized. Secondly, the local government food safety supervision has made a summary of achievements. Through research and analysis, the problems of food safety supervision of local government in China are obtained. Finally, through how to strengthen the local government food safety supervision countermeasure and the government consummation supervision angle of view, proposed should draw lessons from the foreign advanced food safety management pattern and the method foundation, unifies the Chinese concrete situation, Establish a food safety supervision system with Chinese characteristics and strengthen the improvement of food safety laws, regulations and standards. Based on the actual situation of food safety supervision by local governments, the effective ways of strengthening food safety supervision by local governments are discussed.
