勞務(wù)派遣工傷賠償制度研究

【摘要】:在經(jīng)濟全球化的今天,全球市場競爭也日益激烈,為了獲得利潤最大化,全球的企業(yè)也在為了如何最大限度地縮減企業(yè)的用工成本而絞盡腦汁。勞務(wù)派遣用工形式因其成本低、用工靈活等特點受到了各大企業(yè)的青睞,并在各行各業(yè)中迅速發(fā)展壯大起來。勞務(wù)派遣作為人力資源服務(wù)業(yè)的重要內(nèi)容在許多方面都具有明顯的優(yōu)勢,如刺激靈活性就業(yè),調(diào)節(jié)勞動力市場配置,促進產(chǎn)業(yè)結(jié)構(gòu)轉(zhuǎn)變,降低用人單位管理成本等方面,而這些又恰好順應(yīng)了我國經(jīng)濟發(fā)展的需要,從而在我國進入了快速發(fā)展繁榮的時期。然而被派遣勞動者隊伍在不斷壯大的同時,勞務(wù)派遣用工形式的弊端也日益暴露,突出表現(xiàn)為被派遣勞動者的工傷保險權(quán)利缺乏有效的保護。近年來,我國的相關(guān)法律法規(guī)對勞動者的工傷保險問題進行了專門的、較為全面的規(guī)制,但是并未針對勞務(wù)派遣工這一特殊用工群體進行單獨規(guī)定。勞務(wù)派遣當中的絕大部分勞動者會被派遣至一線工作,他們遭受工傷損害的幾率較之一般的勞動者會更高,然而,我國立法并沒有針對他們的工傷賠償問題進行專門的規(guī)定。文章首先介紹了相關(guān)的基本理論,為下文的觀點建立起理論支撐,然后結(jié)合被派遣勞動者工傷賠償制度在我國的立法及司法現(xiàn)狀,詳細闡述了我國目前勞務(wù)派遣工傷賠償制度存在的四大問題:第一,工傷保險費的繳納主體規(guī)定不合理;第二,工傷賠償中連帶責任的規(guī)定過于籠統(tǒng);第三,工傷賠償?shù)某绦蛞?guī)定不合理;第四,異地勞務(wù)派遣中工傷保險容易斷保。緊接著,分析了當前勞務(wù)派遣工傷賠償制度存在的問題之原因:派遣單位、用工單位和被派遣勞動者之間法律關(guān)系的規(guī)制混亂不清;其次,普遍性立法掩蓋了勞務(wù)派遣工工傷賠償?shù)奶厥庑?再次,立法的缺失以及執(zhí)法不嚴;最后,現(xiàn)實中被派遣勞動者加入工會組織的機會比正規(guī)職工少。針對被派遣勞動者工傷賠償制度在我國存在的問題以及經(jīng)過對這些問題存在的原因進行分析,并在對美、德、日三國工傷賠償制度吸收借鑒的基礎(chǔ)上,本文對我國勞務(wù)派遣工傷賠償制度的進一步完善提出了幾點建議:第一,確立工傷保險繳納的連帶保證人責任制度。借鑒德國的立法經(jīng)驗,通過設(shè)置連帶保證人責任來保護被派遣勞動者的工傷賠償請求權(quán);第二,確立工傷賠償中連帶責任的劃分依據(jù)。雙方對外承擔連帶責任后應(yīng)根據(jù)自己的過錯承擔相應(yīng)的賠償責任,無過錯一方可以向有過錯一方全額追償;第三,將用工單位納入工傷認定申請主體范圍之內(nèi)。在保留現(xiàn)行的工傷認定申請主體的前提下,理應(yīng)將用工單位納入申請主體的范圍,同時還應(yīng)對其申請順序進行明確的規(guī)定;第四,刪除異地勞務(wù)派遣中用工單位代為繳納工傷保險的主體地位;第五,立法應(yīng)確立勞動保障部門優(yōu)先確認勞動關(guān)系的職權(quán),從而使其工傷賠償權(quán)益獲得最大程度的保護。為縮減工傷認定程序耗費的時間,在處理工傷認定過程中,勞動保障行政部門在各權(quán)力主體中具有優(yōu)先認定權(quán),并且將該項規(guī)定上升到立法層面,提高其法律位階;第六,強化勞動保障行政部門的監(jiān)督檢查權(quán)。確保勞務(wù)派遣中有關(guān)保護勞動者權(quán)益的相關(guān)立法得到正確的實施,是建立一個健康、和諧的勞務(wù)派遣市場的一項有效舉措;第七,促進行業(yè)協(xié)會與工會職責相銜接,共同保障被派遣勞動者工傷損害得到有效賠償。
[Abstract]:In the economic globalization, the global market competition is also becoming more and more intense. In order to maximize the profit, the world's enterprises are in order to minimize the cost of the enterprise's employment. As a result of its low cost and flexible employment, the form of labor-dispatch employment has been favored by the major enterprises and developed rapidly in all walks of life. The important content of the labor dispatch as the human resource service industry has obvious advantages in many aspects, such as stimulating the flexible employment, adjusting the labor market configuration, promoting the transformation of the industrial structure, reducing the management cost of the employing unit, and the like, And these, in turn, conform to the needs of our country's economic development, so that it has entered a period of rapid development and prosperity in our country. However, while the workforce of the dispatched workers is growing, the abuse of the form of labor dispatch employment is also increasingly exposed, and the outstanding performance is the lack of effective protection of the injury-related injury insurance rights of the dispatched workers. In recent years, the relevant laws and regulations of our country have made a special and comprehensive regulation on the work-related injury insurance of the workers, but do not specify the special employment group for the labor dispatch workers. Most of the workers in the service dispatch will be dispatched to the first line, and their chances of injury to work-related injuries are higher than those of ordinary workers. However, our legislation does not specifically provide for their work-related injury compensation. The article first introduces the related basic theory, establishes the theoretical support for the following point of view, then combines the labor injury compensation system of the dispatched worker in our country's legislation and the current situation of the judicial, elaborated the four major problems of the current labor dispatch injury compensation system in our country: first, The subject of the payment of work-related injury insurance fees is unreasonable; the provisions of joint and several liability in the second and the work-related injury compensation are too general; the third, the procedure for compensation for industrial injury is unreasonable; and fourthly, the work-related injury insurance in the off-site labor dispatch is easy to cut off. Then, the reason of the problem of the current labor dispatch injury compensation system is analyzed: the regulation of the legal relationship between the dispatched unit, the employing unit and the dispatched worker is not clear; secondly, the general legislation covers the particularity of the work-related injury compensation of the labor-dispatching workers; and again, The lack of legislation and the lax enforcement of the law; in the end, the opportunity to send workers to the trade union organization in reality is less than that of the regular staff. In view of the problems existing in the work-related injury compensation system of the dispatched workers in China and the reasons for these problems, and on the basis of the reference to the injury compensation system of the three countries in the United States, Germany and Japan, In this paper, some suggestions are put forward for the further improvement of the compensation system for the labor-related work-related injury in China: first, the system of liability for the worker's duty to pay the work-related injury insurance is established. Based on the experience of Germany's legislation, the right of compensation for the work-related injury of the dispatched worker is protected by the establishment of the guarantor's responsibility, and the second part establishes the basis for the division of the joint and several liability in the compensation of the industrial injury. After the two parties are jointly and severally liable, the two parties shall bear the corresponding liability for compensation according to their own fault, and the party with no fault may recover the full compensation to the party with the fault; and thirdly, the employing unit shall be included in the scope of the main body of the industrial injury identification application. Under the premise of keeping the current work-related injury identification application subject, the employing unit should be included in the scope of the application subject, and the application sequence should be clearly specified; the fourth, the position of the employing unit in the off-site service dispatch to pay the work-related injury insurance shall be deleted; and the fifth, The legislation should establish the authority of the labor relation to confirm the labor relation, so that the rights and interests of the work-related injury can be protected to the maximum extent. In order to reduce the time taken by the work-related injury identification procedure, in the process of handling the work-related injury, the labor security administrative department has the right of priority determination in the power main body, and the provision is raised to the legislative level and the legal order of the administrative department is improved; and the sixth, To strengthen the supervision and inspection right of the administrative department of labor security. To ensure the correct implementation of relevant legislation related to the protection of the rights and interests of the workers in the labor dispatch, which is an effective measure for establishing a healthy and harmonious labor-dispatching market; and 7, promoting the connection between the trade associations and the trade union responsibilities, And jointly guarantee that the dispatched worker's work-related injury is effectively compensated.
