【摘要】："末位淘汰"不屬于法律范疇,它是人力資源管理的基本手段。許多用人單位都將"末位"與"不能勝任工作"同等看待,這是非常有害的誤讀。我國(guó)"末位淘汰"指導(dǎo)案例之參照效力與《紀(jì)要》之內(nèi)部效力基礎(chǔ)都特別薄弱,并不能解決"末位淘汰"的根本問題。克服缺陷應(yīng)當(dāng)從勞動(dòng)立法與勞動(dòng)政策上進(jìn)行。"末位淘汰"指導(dǎo)案例與《紀(jì)要》"升華"之路徑是:第一,構(gòu)建我國(guó)勞動(dòng)法之"成文法+判例法"模式,將指導(dǎo)案例"升華"為"判例案例",實(shí)現(xiàn)成文法與判例法之融合;第二,構(gòu)建我國(guó)勞動(dòng)法"勞動(dòng)政策+勞動(dòng)立法"模式,合法有效地解決實(shí)踐中各種不同而復(fù)雜的"末位淘汰"案件。
[Abstract]:The final elimination does not belong to the category of law, it is the basic means of human resource management. It is a very harmful misreading that many employers treat "last" as "incompetent". The reference effectiveness of the guiding cases of "final elimination" in China and the internal effectiveness basis of "summary" are all very weak and can not solve the fundamental problem of "final elimination". Overcoming defects should be done in terms of labour legislation and labour policy. " The last way to eliminate "guiding case" and "sublimation" of "summary" is as follows: first, to construct the model of "statutory case law" in China's labor law, to sublimate the guiding case into "case", and to realize the fusion of statute law and case law; Secondly, we should construct the labor legislation model of labor policy in our country, and solve all kinds of different and complicated cases of "final elimination" legally and effectively.
