【摘要】：目前,互聯(lián)網(wǎng)金融市場(chǎng)準(zhǔn)入機(jī)制存在監(jiān)管法制滯后、主體混亂、方式不當(dāng)、條件模糊等法律難題。為此,我國(guó)互聯(lián)網(wǎng)金融準(zhǔn)入監(jiān)管機(jī)制的法治構(gòu)建應(yīng)貫徹法定、公平、績(jī)效、適度的監(jiān)管原則,在區(qū)分互聯(lián)網(wǎng)經(jīng)營(yíng)者、投資者及消費(fèi)者的特點(diǎn)及明確互聯(lián)網(wǎng)金融平臺(tái)的法律定位下,通過(guò)法治的方式界明不同模式互聯(lián)網(wǎng)金融的監(jiān)管主體、方式及條件。與此同時(shí),應(yīng)從以下幾方面建立和完善相關(guān)配套制度:健全客戶資金第三方存管制度;完善信息披露與風(fēng)險(xiǎn)提示制度;構(gòu)建互聯(lián)網(wǎng)金融信用評(píng)價(jià)體系;建立合格投資者制度;強(qiáng)化消費(fèi)者權(quán)利保護(hù)機(jī)制。
[Abstract]:At present, the legal system of Internet financial market access is lagging behind, the subject is confused, the way is improper, the condition is vague and so on. Therefore, the construction of the rule of law of the supervision mechanism of Internet financial access in our country should carry out the legal, fair, performance, and so on. Under the principle of moderate supervision, under the condition of distinguishing the characteristics of Internet operators, investors and consumers and clarifying the legal position of Internet financial platform, the main body of supervision of different modes of Internet finance can be clearly defined by the way of rule of law. At the same time, we should establish and perfect the relevant supporting system from the following aspects: perfect the third party deposit and management system of customer funds, perfect the information disclosure and risk prompt system, construct the Internet financial credit evaluation system; Establish QFII system and strengthen consumer rights protection mechanism.
