【摘要】:針對銀行個人理財業(yè)務(wù),以現(xiàn)實案例為基礎(chǔ),本文提出了一個基于產(chǎn)品和契約類型差異性的分析銀行和客戶所應(yīng)承擔(dān)義務(wù)的框架。產(chǎn)品風(fēng)險性、收益性(兩者都應(yīng)考慮程度和概率)、流動性(包括期限和提前終止條件)三大要素的匹配程度可用來度量客戶風(fēng)險和收益的不對稱性,從而評判銀行適當(dāng)性和告知義務(wù)的履行情況。銀行與客戶間的契約關(guān)系差異也很重要,從一次性契約、多次契約到長期契約,客戶的審慎義務(wù)有所放松;而對于銀行適當(dāng)性、告知義務(wù)的要求也應(yīng)逐漸降低,但信義義務(wù)相應(yīng)增強,審查重點也更多地轉(zhuǎn)向利益沖突的防范。
[Abstract]:The bank personal financial services, based on the actual case, this paper proposes a contract and product type difference analysis based on the bank and the customer should bear obligations of the framework. The product risks, profitability (both of which should be considered and the degree of probability), liquidity (including term and early termination conditions) asymmetry the matching degree of the three factors can be used to measure the risks and benefits of customers, so as to judge the appropriateness and the obligation to inform the bank performance. The contractual relationship between banks and customers is also very important, from a one-time contract to contract, many long-term contracts, careful duty customers have to relax; the bank told adequacy. The compulsory requirements should be gradually reduced, but the fiduciary duty intensified prevention review focus more to conflicts of interest.
