【摘要】：大數(shù)據(jù)時(shí)代的到來(lái)既帶來(lái)便利也帶來(lái)信息失控的風(fēng)險(xiǎn),從而必然產(chǎn)生對(duì)被遺忘權(quán)的需求,刑事領(lǐng)域也同樣存在被遺忘權(quán)的適用空間。然而刑事領(lǐng)域的被遺忘權(quán)可能與大數(shù)據(jù)時(shí)代的信息開(kāi)放、新聞自由、犯罪控制等法益產(chǎn)生沖突,面對(duì)沖突不同國(guó)家從立法到司法層面可能作出不同的選擇。歐盟《一般數(shù)據(jù)保護(hù)條例》第17條規(guī)定了被遺忘權(quán)的適用情形及其限制條件,可以對(duì)刑事領(lǐng)域被遺忘權(quán)的邊界確立提供參考。通過(guò)"申請(qǐng)+審查"的被遺忘權(quán)行使模式,可以解決其與公共安全、司法公正、人權(quán)保護(hù)等的矛盾。我國(guó)目前在司法中尚未承認(rèn)被遺忘權(quán),但刑事立法中已有被遺忘權(quán)的某些原始樣態(tài),可以在此基礎(chǔ)上正式確立刑事領(lǐng)域被遺忘權(quán)并審慎地拓展其適用范圍。
[Abstract]:The arrival of the great data age brings convenience to the risk of information loss, so it is necessary to have the right to be forgotten, and the application space of the right to be left in the criminal field is also the same. However, the right to be forgotten in the criminal field may conflict with the information of the large data age, the freedom of the press, the crime control, and so on, and the different countries in the face of the conflict may make different choices from the legislation to the judicial level. The application of the right to be forgotten and its limitations are set out in the European Union for the Protection of the General Data Protection Act, which provides a reference to the establishment of the boundaries of the right to be forgotten in the criminal sphere. Through the "Application + Review" 's left-to-right exercise mode, it can solve the contradiction with public safety, judicial justice, human rights protection and so on. In our country, we have not yet recognized the right to be forgotten in the administration of justice, but some of the original states of the right to be forgotten in the criminal legislation can be formally established in the criminal area, and the scope of application should be extended prudently.
