【摘要】：海西經(jīng)濟區(qū)戰(zhàn)略的實施在加快福州市工業(yè)化和城鎮(zhèn)化進程并推動經(jīng)濟社會全面發(fā)展的同時,也產(chǎn)生了大量被征地的農(nóng)民群體。這些被征地的農(nóng)民群體不僅失去了賴以為生的土地,而且失去了最根本的生活保障。因此,研究福州市城區(qū)集體土地征用管理工作,探討完善土地征用管理工作的對策,切實維護被征地農(nóng)民的合法權(quán)益,具有重大的理論與現(xiàn)實意義。 本文從服務(wù)型政府的視角出發(fā),將征地管理工作納入到公共管理領(lǐng)域的總體框架之中,采用規(guī)范與實證相結(jié)合的研究方法,重點運用文獻歸納、實地調(diào)研訪談和問卷調(diào)查等方法,探討在傳統(tǒng)管制型政府管理模式下福州市城區(qū)集體土地征用管理工作存在的主要問題,如政府行使征地權(quán)較為隨意、政府征地管理不到位、征地制度安排不合理等,并分析導(dǎo)致這些問題產(chǎn)生的深層次原因,包括經(jīng)濟利益驅(qū)動、征地管理體制相對落后和征地制度改革相對滯后等。隨后,運用比較分析法,在借鑒國內(nèi)外關(guān)于政府征地管理工作先進經(jīng)驗的基礎(chǔ)上,結(jié)合當(dāng)前福州市城區(qū)集體土地征用管理工作中存在的主要問題,依照土地征用管理的相關(guān)理論,提出在服務(wù)型政府管理范式下完善福州市城區(qū)集體土地征用管理的具體方案：一是政府要盡快轉(zhuǎn)變政府職能,依法依規(guī)行使征地權(quán)；二是改進政府征地管理方式,嚴(yán)格實施征地管理,實行“陽光”征地；三是完善征地制度安排,即構(gòu)建多元化的安置補償機制、合理的糾紛解決機制和被征地農(nóng)民有效參與機制。
[Abstract]:The implementation of the strategy of Hercynian Economic Zone accelerates the process of industrialization and urbanization in Fuzhou and promotes the overall development of economy and society, at the same time, it also produces a large number of farmers who have been expropriated. These land-expropriated farmers have lost not only the land on which they depend, but also the most fundamental security of life. Therefore, it is of great theoretical and practical significance to study the management of collective land expropriation in Fuzhou City, to probe into the countermeasures to perfect the management of land requisition and to protect the legitimate rights and interests of the peasants who have been expropriated. In this paper, from the perspective of service-oriented government, the management of land requisition is brought into the overall framework of the public management field, and the research method of combining norms and empirical evidence is adopted, with emphasis on the use of literature induction. This paper discusses the main problems in the management of urban collective land expropriation in Fuzhou under the traditional government management mode, such as the government exercises the right of land expropriation at random, and the management of land expropriation by the government is not in place. The unreasonable arrangement of land expropriation system is analyzed, and the causes of these problems are analyzed, including the drive of economic interests, the relative backwardness of land requisition management system and the lag of land requisition system reform, etc. Then, by means of comparative analysis, on the basis of drawing lessons from the advanced experience of government land expropriation and management at home and abroad, combining with the main problems existing in the management of collective land expropriation in Fuzhou City, According to the relevant theories of land expropriation management, this paper puts forward the concrete plan to perfect the management of collective land expropriation in Fuzhou city under the management paradigm of service-oriented government: first, the government should change the government function as soon as possible and exercise the right of land expropriation according to law; The second is to improve the management of government land requisition, strictly implement the management of land requisition, and carry out "sunshine" land requisition; The third is to perfect the arrangement of land expropriation system, that is, to construct diversified resettlement compensation mechanism, reasonable dispute resolution mechanism and effective participation mechanism of land-expropriated farmers.
