【摘要】：高校在長期發(fā)展過程中形成的經(jīng)營性資產(chǎn),為我國高等教育事業(yè)做出了重要貢獻,可經(jīng)營的資產(chǎn)是否屬于經(jīng)營性資產(chǎn)以及如何規(guī)范高校經(jīng)營性資產(chǎn)的管理,以規(guī)避法律與廉政風險,成為當前高校經(jīng)營性資產(chǎn)管理與運作的重要問題。本文分析了高校經(jīng)營性資產(chǎn)的內(nèi)涵、經(jīng)營與管理模式,針對高校經(jīng)營性資產(chǎn)存在的法律問題,提出建立符合我國高校自身特點的《高校經(jīng)營性資產(chǎn)管理規(guī)范》,明確經(jīng)營性資產(chǎn)的內(nèi)涵與外延以及高校經(jīng)營性管理各方管理主體的職責、程序,將高校經(jīng)營性資產(chǎn)納入法治軌道,規(guī)避法律與廉政風險。
[Abstract]:The operating assets formed in the long-term development of colleges and universities have made important contributions to the cause of higher education in our country, whether the operable assets belong to the operational assets and how to regulate the management of the operating assets in colleges and universities. In order to avoid the risk of law and clean government, it has become an important issue in the management and operation of operating assets in colleges and universities. This paper analyzes the connotation, management and management mode of operating assets in colleges and universities, and aims at the legal problems existing in operating assets in colleges and universities. This paper puts forward the establishment of the "Management Standard of operating assets in Colleges and Universities", which conforms to the characteristics of Chinese universities, and clarifies the connotation and extension of operational assets, as well as the responsibilities and procedures of the main parties in the management of operational assets in colleges and universities. The management assets of colleges and universities should be brought into the track of rule of law to avoid the risk of law and clean government.
