【摘要】：本文從執(zhí)法者的行動(dòng)策略和內(nèi)幕交易監(jiān)管制度這兩個(gè)方面,分析了我國(guó)內(nèi)幕交易法律的完備度,并尋找我國(guó)內(nèi)幕交易監(jiān)管有效性相對(duì)較弱的原因。通過(guò)與發(fā)達(dá)國(guó)家證券市場(chǎng)執(zhí)法策略和制度安排的比較,發(fā)現(xiàn)內(nèi)幕交易法律的不完備性將直接影響到內(nèi)幕交易監(jiān)管的有效性。一個(gè)國(guó)家的內(nèi)幕交易法律越完備,其內(nèi)幕交易監(jiān)管的有效性也就越強(qiáng)。
[Abstract]:This paper analyzes the completeness of the insider trading law in our country from the two aspects of the law enforcement strategy and the insider trading supervision system, and finds out the reasons for the relatively weak effectiveness of the insider trading supervision in our country. By comparing with the law enforcement strategies and institutional arrangements in developed countries, it is found that the incompleteness of insider trading laws will directly affect the effectiveness of insider trading supervision. The more complete the insider trading laws of a country, the stronger the effectiveness of its insider trading regulation.
