【摘要】：歐盟委員會(huì)繼2010年10月20日發(fā)布關(guān)于歐盟金融業(yè)危機(jī)管理框架后,于2011年1月6日再次對(duì)外公布了關(guān)于歐盟金融機(jī)構(gòu)復(fù)原與處置框架的工作文件,該文件是泛歐金融機(jī)構(gòu)破產(chǎn)體系建設(shè)的重要步驟。根據(jù)金融機(jī)構(gòu)所處的不同風(fēng)險(xiǎn)狀況,該危機(jī)處置框架分設(shè)了風(fēng)險(xiǎn)阻卻、早期干預(yù)與危機(jī)處置三個(gè)層次;同時(shí)提供了企業(yè)出售工具、過(guò)橋銀行工具、資產(chǎn)剝離工具以及債務(wù)轉(zhuǎn)換工具來(lái)進(jìn)行危機(jī)金融機(jī)構(gòu)的處置。該框架是歐盟在此次金融危機(jī)處置過(guò)程中的經(jīng)驗(yàn)與教訓(xùn)的總結(jié),也反映出未來(lái)法律變化的趨勢(shì)。其中,風(fēng)險(xiǎn)阻卻的法律措施、金融集團(tuán)內(nèi)部財(cái)務(wù)支持、特別管理人的任命、危機(jī)處置基金等制度內(nèi)容值得借鑒。
[Abstract]:Following the release of the EU Financial crisis Management Framework on October 20th 2010, the European Commission again published a working paper on the EU Financial institutions recovery and disposal Framework on January 6th 2011, This document is an important step in the construction of the financial institution bankruptcy system in pan-Europe. According to the different risk situation of the financial institution, the framework of the crisis disposal is divided into three levels: risk resistance, early intervention and crisis disposal. At the same time, it provides enterprise selling tools, bridge bank tools, asset divestiture tools and debt conversion instruments to deal with crisis financial institutions. The framework is a summary of the EU's experience and lessons learned in the handling of the financial crisis. It also reflects the trend of law change in the future. Among them, legal measures of risk resistance, financial support within financial groups, appointment of special managers and crisis disposal funds are worthy of reference.
