【摘要】：郵儲(chǔ)銀行代理營(yíng)業(yè)機(jī)構(gòu)是指經(jīng)銀行業(yè)監(jiān)督管理機(jī)構(gòu)批準(zhǔn)取得金融許可證,在郵儲(chǔ)銀行委托業(yè)務(wù)范圍內(nèi)辦理儲(chǔ)蓄等金融業(yè)務(wù)的郵政企業(yè)營(yíng)業(yè)機(jī)構(gòu),是我國(guó)郵政儲(chǔ)蓄管理體制改革的特殊產(chǎn)物。國(guó)外的研究主要集中在郵政儲(chǔ)蓄的形式等方面。國(guó)內(nèi)的相關(guān)研究主要集中在郵儲(chǔ)銀行不同階段的改革以及在改革進(jìn)程中代理營(yíng)業(yè)機(jī)構(gòu)存在的風(fēng)險(xiǎn)及管理對(duì)策等方面。本文以資陽(yáng)市為例,從法律角度出發(fā),主要從關(guān)聯(lián)關(guān)系和代理關(guān)系兩個(gè)角度進(jìn)行分析,針對(duì)關(guān)聯(lián)關(guān)系和代理關(guān)系的異化對(duì)代理營(yíng)業(yè)機(jī)構(gòu)經(jīng)營(yíng)和發(fā)展產(chǎn)生的影響,提出針對(duì)性的法律建議,控制風(fēng)險(xiǎn)。
[Abstract]:The postal savings bank agency business organization refers to the approval of the banking regulatory agency to obtain a financial license, the postal savings bank commissioned postal enterprises within the business scope for savings and other financial business operations, is a special product of the reform of the postal savings management system in China. The form and other aspects of foreign research mainly focuses on the research of postal savings. The main focus on the reform of different stages of the postal savings bank and agency business organizations in the process of reform of the existing risks and management countermeasures. This paper takes Ziyang city as an example, from a legal point of view, mainly carries on the analysis from two angles of the relationship and the influence to the agency relationship, alienation relationship and agency relationship of the business organization operation and development, put forward the legal advice of risk control.
