【摘要】：專利權是知識產權的重要組成部分。專利行政執(zhí)法是中國知識產權行政保護體系中極具中國特色的一項制度,該制度獨特之處在于專利管理機關有權直接執(zhí)法。當前,隨著專利侵權案件的增加,越來越多的問題在專利行政執(zhí)法工作中暴露出來,“雙軌制”去留的爭論也逐漸喪失其在法律實務界和學術界研究領域的獨占地位。但是,對專利行政執(zhí)法體制的研究還不夠深入。 本文從我國專利行政執(zhí)法保護制度的法學概念出發(fā),分析其相關法律規(guī)定及其發(fā)展歷程,并對國外相關專利行政保護體制進行研究與思考,通過對專利行政執(zhí)法現(xiàn)狀的分析,并以此為基礎對目前存在的法律問題提出完善建議。本文在導論部分厘清論文選題背景、研究意義、思路和方法及本文創(chuàng)新之處后,將分為四個部分進行論述。 第一部分對專利行政執(zhí)法的概念予以界定,并就相關爭議進行討論；第二部分對國內外專利執(zhí)法體制進行研究及思考,通過分析各國專利執(zhí)法制度的獨特之處,挖掘其與我國現(xiàn)行規(guī)定之間的差異：第三部分揭示我國專利行政執(zhí)法所存在的問題,包括執(zhí)法依據的不足、執(zhí)法工作在實踐中遇到的阻礙以及銜接配合機制不完善等方面；最后,針對存在的問題提出完善建言,主要從加強專利執(zhí)法權限及執(zhí)法效果、防止地方保護主義、完善專利執(zhí)法程序、執(zhí)法環(huán)境及司法銜接機制等六個方面提出了完善專利行政執(zhí)法制度的建議。
[Abstract]:Patent right is an important part of intellectual property rights. Patent administrative law enforcement is a system with Chinese characteristics in the administrative protection system of intellectual property rights in China. At present, with the increase of patent infringement cases, more and more problems have been exposed in patent administrative law enforcement, and the debate of "two-track system" has gradually lost its exclusive position in the field of legal practice and academic research. However, the study of patent administrative law enforcement system is not deep enough. Based on the legal concept of patent administrative law enforcement and protection system in China, this paper analyzes its relevant legal provisions and its development process, and studies and ponders the relevant patent administrative protection system in foreign countries, through the analysis of the current situation of patent administrative law enforcement. On this basis, this paper puts forward some suggestions on the existing legal problems. After the introduction part clarifies the background, research significance, ideas and methods of this paper and the innovation of this paper, it will be divided into four parts to discuss. The first part defines the concept of patent administrative law enforcement and discusses the related disputes. The second part studies and thinks about the patent law enforcement system at home and abroad, analyzes the uniqueness of the patent law enforcement system in various countries, and excavates the differences between it and the current regulations of our country. The third part reveals the problems existing in the patent administrative law enforcement in our country. Including the lack of basis for law enforcement, the obstacles encountered in the practice of law enforcement and the imperfect mechanism of convergence and cooperation, and so on. Finally, in view of the existing problems, this paper puts forward some suggestions for perfecting the patent law enforcement, mainly from strengthening the jurisdiction and effect of patent law enforcement, preventing local protectionism, and perfecting the procedures of patent law enforcement. This paper puts forward some suggestions on perfecting the patent administrative law enforcement system from six aspects, such as the law enforcement environment and the judicial connection mechanism.
