【摘要】：知識產(chǎn)權(quán)融資是知識資本和金融資本相互結(jié)合的產(chǎn)物。知識產(chǎn)權(quán)融資的形式主要有知識產(chǎn)權(quán)質(zhì)押融資、知識產(chǎn)權(quán)信托、知識產(chǎn)權(quán)證券化、知識產(chǎn)權(quán)作價入股等。本文側(cè)重于文獻分析,從知識產(chǎn)權(quán)價值評估、商業(yè)銀行質(zhì)押融資風險管理、質(zhì)押融資模式等角度研究了知識產(chǎn)權(quán)質(zhì)押融資,從功能作用、運作流程等角度分析了知識產(chǎn)權(quán)信托,從運作流程、操作模式、風險控制等角度研究了知識產(chǎn)權(quán)證券化,從法律角度分析了知識產(chǎn)權(quán)作價入股。研究結(jié)果顯示,現(xiàn)有知識產(chǎn)權(quán)融資研究在知識產(chǎn)權(quán)質(zhì)量、知識產(chǎn)權(quán)價值評估等方面存在不足,今后需要從知識產(chǎn)權(quán)組合融資、地區(qū)知識產(chǎn)權(quán)融資案例和產(chǎn)業(yè)知識產(chǎn)權(quán)融資等方面進行探索。
[Abstract]:Intellectual property financing is the product of the combination of intellectual capital and financial capital. The forms of intellectual property financing mainly include intellectual property pledge financing, intellectual property trust, intellectual property securitization, intellectual property pricing and so on. This paper focuses on the literature analysis, studies the intellectual property pledge financing from the aspects of intellectual property value evaluation, commercial bank pledge financing risk management, pledge financing mode and so on, and analyzes the intellectual property trust from the angle of function, operation process and so on. This paper studies the securitization of intellectual property rights from the aspects of operation process, operation mode and risk control, and analyzes the value of intellectual property rights into shares from the angle of law. The results show that the existing research on intellectual property financing has shortcomings in the aspects of intellectual property quality, intellectual property value evaluation, and so on, and it needs to be financed from the intellectual property portfolio in the future. Regional intellectual property rights financing cases and industrial intellectual property rights financing and other aspects of exploration.
