【摘要】：2014年10月12日《生物多樣性公約關(guān)于獲取遺傳資源和公正公平分享其利用所產(chǎn)生惠益的名古屋議定書》(簡(jiǎn)稱《名古屋議定書》)的正式生效標(biāo)志著它已進(jìn)入全面實(shí)施階段�！睹盼葑h定書》在國(guó)家層面的有效實(shí)施需要國(guó)家立法提供保障。本文從法律地位、術(shù)語(yǔ)與定義、獲取與審批、后續(xù)監(jiān)管、跟蹤監(jiān)測(cè)等方面探討了獲取與惠益分享(access and benefit-sharing,ABS)國(guó)家立法需要深入研究的問(wèn)題,提出獲取與惠益分享國(guó)家立法應(yīng)與現(xiàn)有法律法規(guī)協(xié)同增效,明確生物遺傳資源及相關(guān)傳統(tǒng)知識(shí)所有權(quán),區(qū)別商業(yè)與非商業(yè)獲取;增加術(shù)語(yǔ)與定義以厘清概念,并促進(jìn)某些條款的可操作性;明確ABS主管當(dāng)局、資源主管部門和獲取審批材料清單,獲取申請(qǐng)的準(zhǔn)予形式和內(nèi)容,實(shí)行分類管理與審批獲取活動(dòng),在鼓勵(lì)科研的同時(shí)有效規(guī)范和監(jiān)管商業(yè)開發(fā)的獲取行為,特別是獲取出境行為,同時(shí)要考慮特殊情形的獲取管理;通過(guò)遵守證書從提供國(guó)和使用國(guó)的角度進(jìn)行后續(xù)監(jiān)管;保留獲取樣品憑證,建立檢查點(diǎn)對(duì)獲取、利用、知識(shí)產(chǎn)權(quán)等各個(gè)環(huán)節(jié)進(jìn)行跟蹤監(jiān)測(cè),以確保獲取與惠益分享國(guó)家法律的有效實(shí)施。
[Abstract]:The entry into force on 12 October 2014 of the Nagoya Protocol to the Convention on Biological Diversity on access to genetic resources and the fair and equitable sharing of benefits arising from its utilization (referred to as the Nagoya Protocol) marks the beginning of its completion The effective implementation of Nagoya Protocol at the national level needs to be guaranteed by national legislation. In this paper, the legal status, terminology and definition, acquisition and approval, follow-up supervision, follow-up monitoring and other aspects of access and benefit-sharing (access and benefit-sharing,ABS) national legislation need to be further studied. It was suggested that national legislation on access and benefit-sharing should be synergistic with existing laws and regulations to clarify the ownership of biological genetic resources and related traditional knowledge and to distinguish between commercial and non-commercial access; The addition of terms and definitions to clarify concepts and facilitate the operationalization of certain provisions; Make clear the competent authority of ABS, the department in charge of resources and obtain the list of examination and approval materials, obtain the form and content of the approval of the application, carry out classified management and examination and approval activities, encourage scientific research and effectively standardize and supervise the acquisition behavior of commercial development at the same time, In particular, the behavior of obtaining exit should be taken into account in the administration of acquisition under special circumstances; (B) Follow-up control from the point of view of the provider and the user State through compliance with the certificate; Retention of sample certificates, establishment of checkpoints to track and monitor access, utilization, intellectual property, etc., to ensure effective implementation of national laws on access and benefit-sharing.
