【摘要】：話語(yǔ)與知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)秩序存在著相互建構(gòu)的關(guān)系:一方面,話語(yǔ)建構(gòu)知識(shí)產(chǎn)權(quán)國(guó)際立法議題、論證立法的合理性、影響國(guó)際規(guī)范的內(nèi)化,從而能動(dòng)地作用于知識(shí)產(chǎn)權(quán)國(guó)際法律制度的規(guī)范生成以及規(guī)范遵守;另一方面,秩序有著話語(yǔ)生產(chǎn)、話語(yǔ)框定及意識(shí)形態(tài)功能,知識(shí)產(chǎn)權(quán)國(guó)際立法形成了話語(yǔ)的基點(diǎn),規(guī)約著話語(yǔ)的規(guī)則,在最大限度上決定著"誰(shuí)有權(quán)說(shuō)并被聽(tīng)到"�；诖�,中國(guó)宜采取相應(yīng)的策略推進(jìn)知識(shí)產(chǎn)權(quán)話語(yǔ),加強(qiáng)對(duì)知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)秩序的影響力。
[Abstract]:There is a relationship between discourse and the international protection order of intellectual property rights. On the one hand, the discourse constructs the topic of international legislation of intellectual property rights, demonstrates the rationality of legislation, and influences the internalization of international norms.On the other hand, order has the functions of discourse production, discourse framing and ideology, and the international legislation of intellectual property rights forms the basis of discourse.The rules governing words determine, to the maximum extent, who has the right to speak and be heard.Therefore, China should adopt corresponding strategies to promote intellectual property discourse and strengthen its influence on the international order of intellectual property protection.
