從國外關(guān)于計算機游戲侵權(quán)的判例看計算機游戲的著作權(quán)保護

【摘要】:計算機游戲是在電子計算機上運行,具有娛樂功能的計算機軟件。它是一種新興的娛樂方式,同時也是一個新興的產(chǎn)業(yè)部門,在吸引了成千上萬玩家的同時,也帶來了巨大的經(jīng)濟效益。我國的計算機游戲產(chǎn)業(yè)雖然與其他發(fā)達國家相比起步較晚,但是在加入WTO以后,隨著計算機在家庭使用的普及,人民群眾對計算機游戲的需求也迅速增加,計算機游戲產(chǎn)業(yè)迎來了一個飛速發(fā)展的階段。計算機游戲從誕生到現(xiàn)在已經(jīng)成為一個熱門的產(chǎn)業(yè),,并且進入了相對成熟的時期。 但是隨著游戲產(chǎn)業(yè)的迅猛發(fā)展,對計算機游戲的知識產(chǎn)權(quán)保護卻滯后于這一速度。游戲市場繁榮的背后存在著一系列亟待解決的問題。如果這些問題不能得到有效的解決,將極大影響我國游戲產(chǎn)業(yè)市場的健康發(fā)展。 計算機游戲軟件作為一種計算機程序受到著作權(quán)法的保護,未經(jīng)權(quán)利人許可對計算機游戲軟件的復(fù)制是侵害計算機程序作品復(fù)制權(quán)的行為,改寫程序代碼的行為也可能侵害到軟件的改編權(quán)和保持作品完整性權(quán)。然而,相對于其他計算機程序,一款計算機游戲往往綜合畫面、音樂與劇本于一體,這就涉及到游戲中的畫面、音樂、文字等一系列連鎖的著作權(quán)保護問題。計算機游戲表現(xiàn)出一種計算機軟件和類似影視作品的雙重屬性。各國對于游戲軟件的保護,也采取了區(qū)別與一般計算機軟件的方法。 本文首先闡述計算機游戲的特征及其與著作權(quán)的關(guān)系,從美國、日本等國的具體案例出發(fā),結(jié)合理論從計算機游戲的法律定位、侵權(quán)判定等各方面進行分析,闡明了國外對計算機游戲法律保護的情況。最后對中國的計算機游戲保護的現(xiàn)狀進行分析,并提出一點建議,以期對促進中國的計算機游戲的著作權(quán)保護提供一些助益。
[Abstract]:Computer games are computer software that runs on electronic computers and has entertainment functions. It is a new form of entertainment and an emerging industry department, attracting thousands of players at the same time. China's computer game industry started late compared with other developed countries, but after China's entry into WTO, with the popularity of computers in the home, The people's demand for computer games has also increased rapidly, and the computer game industry has ushered in a stage of rapid development. Computer games have become a hot industry from birth to now, and have entered a relatively mature period. However, with the rapid development of the game industry, the intellectual property protection of computer games lags behind this speed. There are a series of problems that need to be solved urgently behind the prosperity of the game market. Will greatly affect the healthy development of China's game industry market. As a kind of computer program, computer game software is protected by copyright law. Rewriting code can also infringe upon the right to adapt the software and preserve the integrity of the work. However, compared to other computer programs, a computer game tends to integrate pictures, music and scripts. This involves a series of issues of copyright protection, such as screen, music, text, etc. Computer games show a dual attribute of computer software and similar film and television works. The method of differentiating from general computer software is also adopted. This paper first describes the characteristics of computer games and their relationship with copyright, starting from the specific cases of the United States, Japan and other countries, combined with the theory of computer games from the legal positioning, infringement determination and other aspects of the analysis. This paper expounds the situation of the legal protection of computer games abroad, and finally analyzes the present situation of the protection of computer games in China, and puts forward some suggestions in order to provide some help for promoting the copyright protection of computer games in China.
