【摘要】：國際社會越來越關注知識產(chǎn)權問題,然而,我國尚未形成完善的知識產(chǎn)權法律保護體系,而西方發(fā)達國家的許多成熟法律條案中,有很多值得我國借鑒的優(yōu)秀成果。翻譯任務節(jié)選自Managing Intellectual Property Rights in Citizen Science這篇研究報告的第一部分。任務發(fā)起人是翻譯公司,應翻譯公司要求,目標讀者是國內(nèi)法律研究人員和公民科學家。因此,翻譯此文本可以為我國研究人員和公民科學家在維護知識產(chǎn)權問題上提供借鑒。Managing Intellectual Property Rights in Citizen Science為信息型文本,語言規(guī)范嚴謹,正式性強。該文本以美國知識產(chǎn)權法為例,針對公民科學研究中存在的知識產(chǎn)權問題做出了具體論述。根據(jù)奈達的功能對等理論,翻譯就是在譯語中再造出意義上和風格上與原語信息最切近而又自然流暢的對等信息。因此,譯者采取保持信息傳達嚴謹性的翻譯策略,系統(tǒng)探討了如何在功能對等理論的指導下翻譯法律文本的問題。由于英漢兩種語言之間存在巨大差異,為保持譯文嚴謹性,譯者分別從專業(yè)術語、詞性、信息完整性和句子結構上對譯文進行了處理。對于法律術語,采取加注的方式予以解釋,使譯文更易被理解。對于詞性,根據(jù)英語多用名詞而漢語多用動詞等特點,進行詞性轉換。對于原文省略的信息,根據(jù)語境進行增譯,保證譯文順暢。在句子結構上,對于結構簡單,邏輯關系清晰的句子,采用順譯法。對于結構復雜的長句,采用分譯法,理清原文條理脈絡等邏輯關系,重組句子結構,按照目的語的語言習慣進行表述。法律文體的翻譯具有很強的跨專業(yè)性,不僅需要扎實的語言和翻譯功底,還需要相當深厚的法學造詣。譯者在廣泛收集資料的前提下,在法律翻譯的功能對等方面做出了一些初探,以期為同類文本的翻譯人員提供一定的參考。
[Abstract]:The international community is paying more and more attention to the problem of intellectual property rights. However, China has not yet formed a perfect legal protection system for intellectual property rights. There are many outstanding achievements that our country can learn from. The translation task is excerpted from the first part of Managing Intellectual Property Rights in Citizen Science. The task sponsor is the translation company, at the request of the translation company. The target readers are domestic legal researchers and civil scientists. Therefore, the translation of this text can be used as a reference for Chinese researchers and civil scientists in maintaining intellectual property rights. Managing Intellectual Property Rights in Citizen Science is an informational text. The text takes the American intellectual property Law as an example and makes a specific discussion on the intellectual property problems existing in civil scientific research. According to Nida's functional equivalence theory, Translation is to recreate the meaning and style of equivalent information which is most closely related to the source language information. Therefore, the translator adopts the translation strategy of maintaining the strict communication of information. This paper systematically discusses how to translate legal texts under the guidance of functional equivalence theory. Due to the great differences between English and Chinese, in order to maintain the rigor of the translation, the translators respectively use technical terms and parts of speech. The information integrity and sentence structure are dealt with in the translation. The legal terms are explained by adding notes to make the translation easier to understand. For part of speech, according to the characteristics of English nouns and Chinese multi-purpose verbs, In order to ensure the smooth translation of the omitted information of the original text, the sentence structure is simple, the logical relation is clear, the method is used to translate the sentence, and for the long sentence with complicated structure, The translation of legal style is highly cross-professional and requires not only a solid foundation of language and translation skills, but also a reorganization of sentence structure and expression in accordance with the language habits of the target language. On the premise of extensive collection of information, translators have made some preliminary exploration on the functional equivalence of legal translation, in order to provide some reference for the translators of similar texts.
