【摘要】：3D打印徹底地減少了中間商在生產中的作用,由此可能引發(fā)分散的、非商業(yè)化的知識產權侵權浪潮,擾亂既有的著作權市場秩序和利益天平,因此需要重新界定復制權的內涵,將異體復制明確納入復制權的外延,以解決因立法不明導致理論與實務存在嚴重分歧的問題。私人復制行為的"合理性判斷標準",除了要看是否屬于合理使用制度列舉的具體行為,還應"不與作品正常利用相沖突"及"不損害作者合法權益"。3D打印技術使現(xiàn)有法律原則的適用面臨障礙,征收補償金和技術保護是目前防范3D打印侵權風險的最佳選擇。
[Abstract]:3D printing has completely reduced the role of middlemen in production, which may lead to a wave of decentralized, non-commercial intellectual property rights infringement, disrupting the existing copyright market order and the balance of interests, so the connotation of the right of reproduction needs to be redefined. To explicitly incorporate allogenic replication into the extension of the right of reproduction, In order to solve the problem that there are serious differences between theory and practice due to the unclear legislation. The "rationality judgment standard" of private reproduction behavior, besides whether it is a specific act enumerated by the rational use system, is to be solved. It is also suggested that "not conflict with the normal use of the work" and "not harming the legitimate rights and interests of the author" .3D printing technology make the application of the existing legal principles face obstacles, the collection of compensation and technical protection is the best choice to prevent the risk of 3D printing infringement.
