【摘要】：知識產權同等品是指與政府采購規(guī)格指定的涉及知識產權產品的性能、技術要求或者特性相似的可替代的產品。知識產權同等品采購制度在踐行公平競爭原則、保障采購質量、減輕采購負擔、防范侵權盜版、激勵創(chuàng)新等方面有重要的制度價值。中國政府采購相關規(guī)定盡管考慮了產品可替代性問題,但是沒有同等品的概念及其制度的存在,采取競爭性談判方式作為解決模式。從制度比較優(yōu)勢來看,通過競爭性談判方式采購知識產品的做法合理性不足,而且知識產權同等品制度較之單一來源采購更有優(yōu)勢。需要從實體要求與處理程序、采購審查方式等方面建立健全中國知識產權同等品采購制度。
[Abstract]:IPR equivalents refer to substitutable products that are related to the performance, technical requirements or characteristics of IPR products as specified in government procurement specifications. The procurement system of IPR equivalent goods applies the principle of fair competition and guarantees the quality of procurement. Reducing the burden of procurement, preventing piracy from infringement, encouraging innovation, and so on, have important institutional value. Although the relevant provisions of the Chinese government procurement have considered the issue of product substitutability, there is no concept of equivalent goods and the existence of a system. From the point of view of the comparative advantage of the system, the method of purchasing knowledge products through competitive negotiation is not reasonable enough. It is necessary to establish and perfect China's intellectual property equivalent procurement system from the aspects of substantive requirements and processing procedures, procurement review methods and so on.
