【摘要】：隨著再制造產(chǎn)業(yè)的發(fā)展，原產(chǎn)品制造商（以下簡(jiǎn)稱制造商）與再制造商的利益沖突和知識(shí)產(chǎn)權(quán)沖突問(wèn)題逐漸顯現(xiàn)�，F(xiàn)有司法實(shí)踐和學(xué)術(shù)研究對(duì)再制造是否構(gòu)成侵權(quán)的論點(diǎn)，從“權(quán)利用盡”和“默許認(rèn)可”的原則來(lái)講，可以認(rèn)為修理不構(gòu)成侵權(quán)，而再制造和再造相當(dāng)于生產(chǎn)全新的產(chǎn)品，在未經(jīng)許可的情況下會(huì)構(gòu)成侵權(quán)。因此再制造專利許可是企業(yè)再制造決策必須考慮的因素。目前關(guān)于再制造閉環(huán)供應(yīng)鏈的研究主要集中在廢舊品回收，產(chǎn)品定價(jià)策略，再制造品銷售渠道，，再制造模式等領(lǐng)域，鮮有文獻(xiàn)研究閉環(huán)供應(yīng)鏈中的再制造專利許可問(wèn)題。 本文首先對(duì)再制造的作用與意義進(jìn)行了概述，提出了再制造行業(yè)面臨的專利許可問(wèn)題，并對(duì)涉及再制造與專利許可的國(guó)內(nèi)外研究文獻(xiàn)進(jìn)行了述評(píng)。 其次在細(xì)分綠色消費(fèi)者和普通消費(fèi)者的基礎(chǔ)上，研究了制造商的再制造專利許可行為。分別構(gòu)建了不許可再制造和許可再制造兩種情形下的供應(yīng)鏈定價(jià)模型，求得了制造商和再制造商的最優(yōu)定價(jià)策略以及制造商的最優(yōu)專利許可費(fèi)，并對(duì)不許可再制造和許可再制造兩種情形下的最優(yōu)決策進(jìn)行了比較分析。通過(guò)數(shù)值仿真，分析了綠色消費(fèi)者市場(chǎng)份額、普通消費(fèi)者對(duì)再制造品的接受度對(duì)最優(yōu)專利許可費(fèi)、最優(yōu)產(chǎn)品價(jià)格和供應(yīng)鏈成員利潤(rùn)的影響。 最后研究了制造商的最優(yōu)再制造專利許可策略，在考慮消費(fèi)者偏好的基礎(chǔ)上，分別構(gòu)建了制造商不許可再制造、制造商采取提成許可制許可再制造、制造商采取固定費(fèi)許可制許可再制造情形下的供應(yīng)鏈定價(jià)模型，求得并比較了制造商采取不同的再制造專利許可策略情形下制造商和再制造商的最優(yōu)定價(jià)策略，得出了提成許可制和固定費(fèi)許可制的適用范圍。通過(guò)數(shù)值仿真，分析了消費(fèi)者偏好對(duì)產(chǎn)品價(jià)格、產(chǎn)品銷量和制造商利潤(rùn)的影響。
[Abstract]:With the development of the remanufacturing industry, the conflicts of interest and intellectual property rights between the original product manufacturers (hereinafter referred to as the manufacturers) and the re-manufacturers have gradually emerged. In terms of the principles of "exhaustion of rights" and "tacit approval", it can be considered that repair does not constitute an infringement, and that remanufacturing and reengineering is tantamount to the production of a completely new product. Therefore, remanufacturing patent license is a factor that must be considered in the remanufacturing decision. At present, the research on the closed-loop supply chain of remanufacturing is mainly focused on the recycling of waste goods and the pricing strategy of the products. In the field of remanufacture distribution channel and remanufacturing mode, few literatures have studied the issue of remanufacturing patent license in closed-loop supply chain. In this paper, the role and significance of remanufacturing are summarized, the problems of patent licensing in remanufacturing industry are put forward, and the domestic and international research literatures on remanufacturing and patent licensing are reviewed. Secondly, on the basis of subdividing green consumers and ordinary consumers, this paper studies the manufacturer's remanufacturing patent license behavior, and constructs the supply chain pricing model under the condition of non-licensed remanufacturing and licensing remanufacturing, respectively. The optimal pricing strategy of manufacturer and re-manufacturer and the optimal patent license fee of manufacturer are obtained, and the optimal decision in the case of non-licensed remanufacturing and licensed remanufacturing is compared and analyzed. The effects of market share of green consumers, acceptance of remanufactured products by ordinary consumers on optimal patent licensing fees, optimal product prices and profit of supply chain members are analyzed. Finally, the optimal remanufacturing patent licensing strategy of manufacturer is studied. On the basis of considering consumer preference, the manufacturer does not permit remanufacturing, and the manufacturer adopts royalty license to remanufacture. The manufacturer adopts the supply chain pricing model in the case of fixed fee license and remanufacturing, and obtains and compares the optimal pricing strategy between manufacturer and remanufacturer under different remanufacturing patent licensing strategies. Through numerical simulation, the influence of consumer preference on product price, product sales volume and manufacturer's profit is analyzed.
