【摘要】：微信平臺(tái)在信息傳播技術(shù)領(lǐng)域給人們帶來(lái)便利的同時(shí),也對(duì)傳統(tǒng)意義上的著作權(quán)保護(hù)制度帶來(lái)了新的挑戰(zhàn)。為了更好地處理網(wǎng)絡(luò)信息傳播中的微信作品著作權(quán)侵權(quán)糾紛,本文依據(jù)我國(guó)現(xiàn)行的著作權(quán)保護(hù)方面的法律法規(guī),結(jié)合微信平臺(tái)中存在的實(shí)際侵權(quán)問(wèn)題,剖析了侵權(quán)法律關(guān)系中各方應(yīng)承擔(dān)的責(zé)任,并在對(duì)微信作品著作權(quán)保護(hù)現(xiàn)狀進(jìn)行總結(jié)的基礎(chǔ)之上,提出了完善微信作品著作權(quán)保護(hù)制度的建議。我們可以從以下七個(gè)方面完善我國(guó)的微信作品著作權(quán)保護(hù)制度:明確微信作品合理使用的范圍、明確微信作品著作權(quán)侵權(quán)行為的賠償標(biāo)準(zhǔn)、采用靈活的法律保護(hù)模式、建立暢通的被侵權(quán)人網(wǎng)絡(luò)訴求渠道、完善舉證責(zé)任制度、加強(qiáng)對(duì)微信作品著作權(quán)保護(hù)的技術(shù)規(guī)范和提高保護(hù)意識(shí)等。通過(guò)本次研究,以期微信用戶能夠認(rèn)清微信作品著作權(quán)侵權(quán)行為的危害,強(qiáng)化公眾保護(hù)微信作品著作權(quán)的意識(shí),讓“尊重知識(shí),崇尚創(chuàng)新,誠(chéng)實(shí)守信”的知識(shí)氛圍加快形成,為我國(guó)知識(shí)產(chǎn)權(quán)事業(yè)的發(fā)展和進(jìn)步增添動(dòng)力。
[Abstract]:The WeChat platform brings convenience to people in the field of information technology, but also to the traditional copyright protection system has brought new challenges. In order to better deal with the network information dissemination in WeChat copyright infringement disputes, according to laws and regulations of China's current copyright protection, combined with the actual infringement the presence of WeChat platform, analyzes the legal relationship between the parties of tort should bear the responsibility on the basis of summarizing the current situation and protection of the WeChat copyright, put forward to improve the WeChat copyright protection system. We can from the following seven aspects: the perfection of the WeChat system to protect the copyright of works: clear WeChat works of fair use, clear WeChat works copyright infringement compensation standard, the legal protection mode of flexible, establish smooth infringement Human demands of the network channels, improve the system of burden of proof, strengthen the technical specification of WeChat works copyright protection and improve the protection consciousness. Through this study, to understand the harm of copyright infringement of WeChat to WeChat users, WeChat copyright protection and strengthen public awareness, to "respect knowledge, advocating innovation. Intellectual atmosphere of honesty and trustworthiness" to speed up the formation, adding impetus to the cause of intellectual property rights in China's development and progress.
