【摘要】：《民法總則》第123條通過(guò)列舉知識(shí)產(chǎn)權(quán)客體的方式,對(duì)知識(shí)產(chǎn)權(quán)進(jìn)行了概括性定義。該條確立了知識(shí)產(chǎn)權(quán)類型的"7+N"模式,即著作權(quán)、專利權(quán)、商標(biāo)權(quán)、地理標(biāo)志權(quán)、商業(yè)秘密權(quán)、集成電路布圖設(shè)計(jì)權(quán)、植物新品種權(quán)這7種權(quán)利,再加上代表"N"的兜底款項(xiàng)。不過(guò),這一兜底款項(xiàng)采取嚴(yán)格的法定主義,排除了行政性法規(guī)、地方性法規(guī)、司法解釋和判例創(chuàng)設(shè)新的知識(shí)產(chǎn)權(quán)類型。因此,司法實(shí)踐中要進(jìn)行擴(kuò)張性立法解釋,并加強(qiáng)知識(shí)產(chǎn)權(quán)立法工作,不斷完善知識(shí)產(chǎn)權(quán)權(quán)利體系。
[Abstract]:Article 123 of the General principles of Civil Law defines intellectual property by enumerating the objects of intellectual property. This article establishes the "7N" mode of intellectual property rights, that is, copyright, patent right, trademark right, geographical indication right. The right to trade secrets, the right to layout of integrated circuits, the right to plant new varieties, and the right to represent "N" are added to the bill. However, this sum of money is strictly legalistic and excludes administrative and local laws and regulations. Judicial interpretation and jurisprudence create new types of intellectual property rights. Therefore, in judicial practice, it is necessary to carry out expansionary legislative interpretation, strengthen the legislative work of intellectual property rights, and constantly improve the system of intellectual property rights.
