【摘要】：文化的力量深深融入在民族的創(chuàng)造力、凝聚力和生命力之中，在人類社會飛速運轉(zhuǎn)的今天，文化的崛起更成為國家綜合實力不斷壯大的必然選擇。我國承載著五千年的文明歷史，無數(shù)的歷史痕跡和文明記憶讓人嘆為觀止。如今，厚重的歷史文明開始發(fā)出新的聲音，通過技術(shù)手段來存儲、傳承和開發(fā)文化資源的數(shù)字化保護(hù)方式開始得到越來越多的青睞。然而，如何在數(shù)字化保護(hù)過程中明晰各項權(quán)利狀態(tài)，提高數(shù)字化成果社會化應(yīng)用的安全性和效率性成為一個必須回答的問題，這也正是本文的主題所在。本文總共可分為六個部分，分列六章。 第一章為緒論，筆者著重對研究背景、研究綜述、研究視角進(jìn)行梳理，并嘗試對古代壁畫、數(shù)字化保護(hù)、權(quán)利盤點和權(quán)利識別等重點概念進(jìn)行界定；第二章為我國古代壁畫數(shù)字化成果及其知識產(chǎn)權(quán)保護(hù)狀況概述，本文將對古代壁畫數(shù)字化成果的應(yīng)用現(xiàn)狀及臺灣省權(quán)利盤點實踐經(jīng)驗進(jìn)行分析和展望； 第三章為壁畫數(shù)字化成果權(quán)利盤點的必要性與原則，筆者在借鑒國內(nèi)外成熟經(jīng)驗的基礎(chǔ)上，基于文化戰(zhàn)略、保護(hù)對象、交易安全及應(yīng)用授權(quán)等方面對權(quán)利盤點的必要性進(jìn)行分析梳理，并提出權(quán)利盤點的全面性、準(zhǔn)確性及針對性等原則；第四章為我國古代壁畫數(shù)字化成果權(quán)利盤點流程，筆者嘗試歸納出權(quán)利盤點流程，，并按照我國古代壁畫數(shù)字化成果流程，以獨創(chuàng)性為判斷的總體原則，對圖像采集、圖像修復(fù)、格式轉(zhuǎn)換及集成數(shù)據(jù)庫等階段技術(shù)參與下的數(shù)字化成果權(quán)利屬性進(jìn)行探析； 第五章為權(quán)利盤點的局限及走向，筆者將分析本文論及的權(quán)利盤點所暴露出來的局限性，并嘗試提出未來的權(quán)利盤點走向；第六章為結(jié)論，筆者將對我國古代壁畫數(shù)字化成果形成中的版權(quán)問題進(jìn)行歸納總結(jié)，明晰權(quán)利盤點的相關(guān)研究結(jié)論，并提出本文的不足。 曾幾何時，承載著時代記憶的文化資源漸漸讓世界看到軟的力量，文化不僅可以修身養(yǎng)性，更可以推動經(jīng)濟(jì)的飛躍。期望本文的微弱嘗試可以為傳統(tǒng)文化再次大放異彩提供些許參考，為我國大力踐行文化戰(zhàn)略的浪潮激發(fā)出一點點水花。
[Abstract]:The power of culture is deeply integrated into the creativity, cohesion and vitality of the nation. Today, when the human society is running at full speed, The rise of culture has become an inevitable choice for a country to grow in its comprehensive strength. Our country bears five thousand years of civilization, and countless traces of history and memories of civilization are breathtaking. Now, the thick historical civilization is beginning to make a new sound. More and more digital protection methods of storing, inheriting and developing cultural resources begin to get more and more favor through technical means. However, how to clarify the status of various rights in the process of digital protection, To improve the security and efficiency of the social application of digital achievements is a question that must be answered, which is the theme of this paper. This paper can be divided into six parts, divided into six chapters. The first chapter is the introduction, the author focuses on the research background, research overview, research perspective, and try to define the ancient murals, digital protection, rights inventory and rights identification and other key concepts; The second chapter is an overview of digital achievements and intellectual property rights protection of ancient murals in China. This paper will analyze and prospect the application status of digitized achievements of ancient murals and the practical experience of rights inventory in Taiwan Province. The third chapter is the necessity and principle of the right inventory of fresco digitized achievements. Based on the mature experience at home and abroad, based on the cultural strategy, the author protects the object. In the aspects of transaction security and application authorization, the necessity of rights inventory is analyzed and combed, and the principles of completeness, accuracy and pertinence of rights inventory are put forward. Chapter 4th is the process of right inventory of digital achievements of ancient murals in China. The author tries to sum up the process of right inventory, and according to the process of digitized achievements of ancient murals in our country, taking originality as the general principle of judging, collecting and repairing images, Format conversion and integration of database and other stages of technology participation in digital achievements of the property of the right to carry on the analysis; Chapter 5th is the limitation and trend of the rights inventory, the author will analyze the limitation exposed by the rights inventory, and try to put forward the future rights inventory trend, chapter 6th is the conclusion, The author will sum up the copyright problems in the formation of the digital achievements of ancient murals in China, clarify the relevant research conclusions of the rights inventory, and put forward the shortcomings of this paper. Once upon a time, the cultural resources bearing the memory of the times gradually let the world see the power of softness. Culture can not only cultivate one's own character, It is expected that the weak attempt in this paper can provide some reference for the traditional culture to shine again, and stimulate a little water for the tide of practicing the cultural strategy in our country.
