行政法“信賴?yán)姹Wo(hù)原則”的中國生成

【摘要】:“信賴?yán)姹Wo(hù)原則”于2000年被理論界正式引入中國大陸行政法體系,經(jīng)過14年的發(fā)展,其已經(jīng)成為大陸行政法不可或缺的重要構(gòu)成要素。在其生成過程中,學(xué)理與實(shí)踐構(gòu)成了其生成的兩條脈絡(luò)。2005年以前,作為構(gòu)建這一體系的主要動力,學(xué)理脈絡(luò)通過比較法引入,建構(gòu)了基本的話語結(jié)構(gòu)。而2005年前后,立足于中國本土的實(shí)踐脈絡(luò),通過立法與司法審判,建立了與學(xué)理脈絡(luò)不同的,以“保障政府公信力”為基點(diǎn)的多樣性信賴?yán)姹Wo(hù)框架,成為后一時期信賴?yán)姹Wo(hù)原則生成的決定要素。結(jié)合學(xué)理與實(shí)踐,展望未來,我們認(rèn)為,在未來的發(fā)展中,應(yīng)當(dāng)立足于國情,以保障政府公信力為基點(diǎn),建構(gòu)以案件類型為基礎(chǔ)的綜合普遍性與特殊性的中國信賴?yán)姹Wo(hù)原則。具體而言: 第一部分通過簡單梳理信賴?yán)姹Wo(hù)原則在中國行政法理論與實(shí)踐層面的具體樣態(tài),發(fā)現(xiàn)信賴?yán)姹Wo(hù)原則已經(jīng)開始了其中國化的過程,但是這一過程并未完成的簡單結(jié)論,并提出借助探索其生成歷史的方式進(jìn)行追本溯源,還原其生成過程中的諸多要素,從而對其現(xiàn)狀進(jìn)行界定。 第二部分,對于2000年前后的相關(guān)理論與實(shí)踐的分析,得出2000年可以被視為中國行政法信賴?yán)姹Wo(hù)原則生成的基點(diǎn),以何海波教授為代表的研究者們通過三篇文章,為信賴?yán)姹Wo(hù)原則的中國化構(gòu)建了一個較高層次的起點(diǎn),而這一階段,該原則尚未被應(yīng)用于實(shí)踐。 第三部分,闡述原點(diǎn)時期至2005年“益民公司案”這一階段該原則的中國化發(fā)展徑路,主要通過三方面進(jìn)行論述:一,對理論層面之信賴?yán)姹Wo(hù)原則,誠信原則和合法預(yù)期保護(hù)原則進(jìn)行解析;二,對這一階段的代表性立法,如《行政許可法》進(jìn)行分析;三,對于具有代表性的“益民公司案”和“洋浦大源公司案”進(jìn)行分析,從而得出結(jié)論:該原則在這一階段主要基于理論建構(gòu),立法與司法實(shí)踐助力相對較少,但是這些不多的實(shí)踐已開始反映出其與理論模型的不同。 第四部分,分析從“益民公司案”至2012年前后最高人民法院公布“吳小琴案”等“五案”這一階段中的歷史演進(jìn)。通過理論比較與地方案例的分析,得出這一階段的基本樣態(tài):理論框架穩(wěn)定,但是關(guān)于適用范圍,歷史源流等方面依然存在較大爭議,合法預(yù)期開始代替誠信原則成為主要的相關(guān)原則。而以地方司法實(shí)踐為代表的法院系統(tǒng)開始對這一原則進(jìn)行自主創(chuàng)新,具體表現(xiàn)為:不斷拓展其適用領(lǐng)域,尤以知識產(chǎn)權(quán)領(lǐng)域?yàn)樽;出現(xiàn)五種主要的適用徑路;一些共識逐漸形成:如過錯等;而最高人民法院公布的具有節(jié)點(diǎn)意義的“五案”,雖然具體適用徑路也有所不同,但是其與理論模型的差別已經(jīng)顯而易見:強(qiáng)調(diào)信賴基礎(chǔ)作用下的相對人利益的保護(hù),而這一徑路的基礎(chǔ)便是對于政府公信力的強(qiáng)調(diào)。這一階段,司法實(shí)踐已經(jīng)逐步取代理論界,成為這一原則中國化主要動力。 第五部分,基于前述部分,對于該原則中國化生成歷史進(jìn)行相應(yīng)反省,得出部分理論共識逐步形成但整體仍缺乏本土化關(guān)懷;司法實(shí)踐積極填補(bǔ)空白,但是卻有“徙木立信”一般的泛化憂慮的基本結(jié)論。在此反省基礎(chǔ)上,提出立足于中國國情進(jìn)行建設(shè),以政府公信力保障為基點(diǎn),建立普遍化與特殊化相結(jié)合的多元化適用模式的具體主張。
